Mr. H.D (Da Nang) is currently working at a public service unit. A lecturer who is teaching at another public service unit was transferred to my unit and was also assigned to teach directly. The above civil servant has been appointed to the professional title of lecturer, but the time of transfer is at the end of the school year, so he has not yet participated in teaching but has to wait until the following school year.
Mr. D asked, is this civil servant entitled to preferential teacher allowances? If they are entitled to it, from when, the time of direct teaching (new school year) or the time when the civil servant is transferred to my unit (because in Joint Circular No. 01/2006/TTLT-BGD&DT-BNV-BTC there is no such content)?
The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:
The preferential allowance regime for teachers is being implemented according to the provisions of Decision No. 244/2005/QD-TTg dated October 6, 2005 of the Prime Minister, guided in Joint Circular No. 01/2006/TT-BGD&DT-BNV-BTC dated January 23, 2006.
For teachers who are directly teaching when transferring to a new public service unit, doing teaching work is eligible for preferential teacher allowances from the time of transfer.
The preferential allowance regime for teachers is being implemented according to the provisions of Decision No. 244/2005/QD-TTg dated October 6, 2005 of the Prime Minister, guided in Joint Circular No. 01/2006/TTLT-BGDDT-BNV-BTC dated January 23, 2006.
Accordingly, the subjects of application are teachers (including those who are on probation or contract) on the payroll, who are directly teaching in public educational institutions. For teachers who change jobs and do not participate in teaching, they are not eligible for preferential teacher allowances.
The preferential allowance for teachers is up to 50%
According to Decision No. 244/2005/QD-TTg of the Prime Minister, the preferential allowance for teachers is stipulated as follows:
The 25% allowance applies to teachers who are directly teaching in universities, colleges, academies, training schools of ministries, ministerial-level agencies, agencies under the Government, Party organizations, socio-political organizations at the central level and political schools of provinces and centrally run cities (except for teachers teaching in pedagogical schools, pedagogical faculties and teachers teaching classes of classes - Martinism, Ho Chi Minh thought);
The 30% allowance applies to teachers who are directly teaching in junior high schools, high schools, comprehensive technical centers - career guidance, continuing education centers, vocational training centers in the plains, cities, towns; professional high schools, vocational schools; political training centers of districts, towns, and cities under the province;
The 35% allowance applies to teachers who are directly teaching in kindergartens and primary schools in the plains, cities, and towns; junior high schools, high schools, general technical centers - vocational guidance, continuing education centers, vocational training centers in mountainous areas, islands, remote areas;
The 40% allowance applies to teachers who are directly teaching in pedagogical schools, pedagogical faculties (Universities, colleges, high schools), schools for education and training management staff and teachers of political subjects in vocational secondary schools and vocational schools;
The 45% allowance applies to teachers who are directly teaching classes of Marxism - Lenine and Ho Chi Minh Thought in universities and colleges;
The 50% allowance applies to teachers who are directly teaching in kindergartens and primary schools in mountainous, island, remote and isolated areas.
