Mr. N.V.H said that he is a secondary school teacher. In 2016, he was recruited as a teacher with code 15a. 201, then transferred to Secondary School Teacher rank II, code V.07. 04. 11. In 2023, the locality organized the transfer to a new code, but because he did not hold the rank for 9 years, he still kept the old code V.07. 04. 11.
Mr. H asked, currently he has 9 years of holding grade II old code (code V.07. 04.11), can he switch to a new code and what are the procedures for switching to a new code?
Regarding the above issue, the Ministry of Education and Training (MOET) said that before April 14, 2026, the transfer and ranking of titles for secondary school teachers will be implemented according to the provisions of Circular No. 03/2021/TT-BGDDT dated February 2, 2021 of the Minister of Education and Training stipulating codes, professional title standards and appointments, salary rankings of teaching staff in public secondary schools (some articles have been amended and supplemented in Circular No. 08/2023/TT-BGDDT dated April 14, 2023).
Accordingly, Clause 12, Article 5 of Circular No. 08/2023/TT-BGDĐT stipulates:
From November 3, 2015 to the date this Circular takes effect, in case preschool and general education teachers are appointed to a higher rank after the probation period expires or after achieving a training level higher than the prescribed level but have not met other standards as well as have not been recruited in the exam or promotion consideration organized by competent authorities, they must be reappointed to the correct rank according to regulations (including cases of recruitment before November 3, 2015 and completing the probation period according to regulations after November 3, 2015)".
This case does not include subjects recruited under the policy of attracting and creating a source of cadres from excellent graduates, young scientific cadres or the specific recruitment policy of the locality (if any).
The Ministry of Education and Training believes that, according to information provided by Mr. N.V.H, in 2016, after recruitment, he was immediately appointed to the professional title of Secondary School Teacher rank II without going through exams or promotion consideration.
His case may be subject to the above-mentioned reappointment because the appointment did not ensure that it met the standards of a secondary school teacher rank II and did not meet the principles of professional title appointment according to the law on public employees at the time of appointment.
Mr. H needs to contact directly the competent authority for appointing professional titles of civil servants in the locality to be reviewed the dossier and guided and resolved according to regulations.
