On the National Legal Portal, citizens reflected that they were recruited to teach at a primary school from December 11, 2014, completed a probationary period and were appointed to the civil servant rank of primary school teacher from January 1, 2016.
On June 19, 2018, the citizen was appointed to the professional title of primary school teacher rank II, code V.07.03.07.
By January 22, 2025, citizens will be appointed from the professional title of primary school teacher grade II, code V.07.03.07 to the professional title of primary school teacher grade II, code V.07.03.28, receiving salary grade 1, coefficient 4.00 from February 1, 2025.
After that, according to the notice on reviewing and adjusting professional titles, citizens are subject to the case of having to be reappointed from primary school teacher grade II, code V.07.03.28 to primary school teacher grade III, code V.07.03.29 according to Clause 12, Article 5 of Circular No. 08/2023/TT-BGDĐT. The decision takes effect from May 28, 2026.
Citizens request the Ministry of Education and Training to clarify the method of calculating the rank retention time, whether it is necessary to meet the condition of holding rank III for at least 12 months before registering for promotion to rank II according to the provisions of Clause 16, Article 1 of Decree No. 85/2023/ND-CP, and at the same time ask about the conditions for registering for promotion after being adjusted for professional title.
Answering this content, the Department of Teachers and Educational Administrators (Ministry of Education and Training) said that when being transferred to the professional title of primary school teacher rank III, code V.07.03.29, the previous working time of the teacher is counted as the time holding the professional title of primary school teacher rank III.
Regarding the regulation that public employees must have at least 12 months of holding a lower-ranking professional title adjacent to the expiration date of submitting applications for promotion consideration according to point d, clause 1, Article 32 of Decree No. 115/2020/ND-CP, which has been amended and supplemented in clause 16, Article 1 of Decree No. 85/2023/ND-CP.
The Department of Teachers and Educational Administrators said that this regulation only applies to cases where the time is considered equivalent to the working time with compulsory social insurance contributions before being recruited or received.
The case of a citizen who does not belong to the above-mentioned subjects, therefore does not have to meet the condition of having 12 months of holding the professional title of primary school teacher rank III, code V.07.03.29 when registering for promotion consideration.
Regarding the conditions for considering promotion to the professional title of primary school teacher rank II, the Department of Teachers and Educational Administrators said that the implementation is in accordance with Article 5 of Circular No. 13/2024/TT-BGDĐT and specific regulations in the project, plan, and guidance on organizing promotion consideration of competent authorities in the locality.
If teachers fully meet the standards and conditions for promotion consideration according to regulations and the educational institution where they work has a job position need, they can submit applications to participate in promotion consideration according to the project, plan and instructions of the locality.
