Ms. V.T.H. H. proposed that it is necessary to clarify the content of the number of extra teaching hours in 1 school year of teachers in Circular 21/2025/TT-BGDĐT on paying overtime salaries for teachers with "extra teaching, extra learning" in Circular 29/2024/TT-BGDĐT dated December 30, 2024.
According to Ms. H, if a full-time teacher is short of 10 periods compared to the quota, but that teacher teaches 40 periods to prepare for the graduation exam, then how is that teacher calculated for extra time correctly?
When tutoring (tutoring weak students, preparing for graduation exams, fostering excellent students), the salary is also calculated at 150% of the salary for 1 teaching hour or the regulation on overtime is different from the regulations on tutoring and extra classes.
Regarding the content of Ms. V.T.H. H's petition, the Department of Teachers and Educational Administrators, Ministry of Education and Training, said that according to Clause 5, Article 3 of Circular No. 21/2025/TT-BGDĐT, tasks that have been paid remuneration are not converted to teaching hours to calculate overtime salaries.
Therefore, for tutoring periods for students and fostering excellent students: If money has been paid according to the provisions of Circular No. 29/2024/TTBGDĐT, amended and supplemented by Circular No. 19/2026/TT-BGDĐT, it is not included in the total number of teaching periods to pay overtime salaries; if it has not been paid, it is included in the total number of teaching periods to consider paying overtime salaries according to regulations.
The level of 150% of the salary for 1 teaching session only applies to tutoring sessions for students and fostering excellent students, which are identified as extra teaching hours and have not been paid according to other regimes.
