Ms. A.M was recruited as a civil servant in 2010, appointed to the rank of Principal Primary Teacher, code 15a. 204 in November 2011. In December 2016, she was appointed by the District People's Committee to the professional title of Primary Teacher rank III, code V.07.03.08.
In September 2023, Ms. M was appointed by the District People's Committee to the professional title Primary School Teacher rank III, code V.07.03.29 (at this time she was eligible for the title Primary School Teacher rank II but was only transferred to new rank III).
Ms. M has met the conditions for considering transferring the title of Primary Teacher Grade II according to Circular No. 08/2023-BGDĐT. She asked, if submitting a dossier for consideration of transferring a professional title, from what time will the time of holding a professional title be calculated?
Regarding this issue, the Ministry of Education and Training said that to be appointed to the professional title Primary School Teacher rank II (code V.07.03.28), Ms. A.M must participate and pass the professional title promotion exam from Primary School Teacher rank III to rank II organized by competent authorities in the locality in accordance with the law.
According to the provisions of Clause 1 and Clause 2, Article 31 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of public employees (amended and supplemented in Decree No. 85/2023/ND-CP dated December 7, 2023), the consideration of professional title promotion must be based on the job position, professional title standards and in accordance with the structure of public employees according to professional titles of public non-business units approved by competent authorities.
At the same time, civil servants are allowed to register for promotion to professional titles if public non-business units have needs and meet sufficient standards and conditions according to regulations.
Standards and conditions for considering promotion to the professional title of primary school teacher rank II (code V.07.03.28) are implemented according to the provisions of Article 5 of Circular No. 13/2024/TT-BGDDT dated October 30, 2024 of the Minister of Education and Training and specific regulations in the project, plan, and guidance on organizing promotion consideration of competent authorities in the locality.
In which, the time holding the professional title Primary School Teacher rank III is only one of the standards and conditions to be registered to participate in promotion consideration.
In case Ms. M has fully met the standards and conditions for promotion consideration according to regulations, the educational institution where she works has a need and still has quotas for Primary School Teacher Grade II; at the same time, the competent authority in the locality organizes promotion consideration from the professional title Primary School Teacher Grade III to the professional title Primary School Teacher Grade II, she can submit a dossier to register to participate in promotion consideration according to the project, plan and guidance of the locality.
If during the working period there is no interruption according to the provisions of law, the time holding the professional title of Primary School Teacher rank III for her is calculated from November 2011 to June 2026, which is about 14 years and 6 months.
