Mr. T.H. T is a military officer who was assigned to work at T.N University in 2005, assigned to teach at the National Defense and Security Education Center. In 2012, he applied for a transfer and was accepted by the University, assigned to work as a lecturer at the National Defense and Security Education Center until now.
Mr. T asked, is his working time from 2005 to 2012 counted as working time in the education sector to calculate the time for considering awarding the title of Meritorious Teacher?
According to Article 8 of the 2013 Law on National Defense and Security Education: "1. National Defense and Security Education Centers are educational institutions, fostering national defense and security knowledge, military skills for subjects according to the provisions of this Law".
However, in Clause 3, Article 8 of Decree No. 35/2024/ND-CP, it is said that "Professional talent is specified for each subject..." so it is not possible to determine which point the teacher currently working at National Defense and Security Education Centers belongs to. If it is determined to be in point d, Clause 3, Article 8, it is very inappropriate, especially the criteria for topics and doctoral guidance.
Mr. T asked, with the specific nature of the systems of National Defense and Security Education Centers nationwide today, what criteria are teachers at the Centers applied to propose the title of Meritorious Teacher according to to be appropriate?
Regarding this issue, the Ministry of Education and Training said that the time for considering awarding the title of Meritorious Teacher is specified in Clause 1, Article 8 of Decree No. 35/2024/ND-CP dated April 2, 2024 of the Government: "Teachers with a time of direct nurturing and teaching from 15 years or more; for educational institution management officials, management officials at educational management agencies, educational research officials must have worked in the industry for 20 years or more, including 10 years or more of direct nurturing and teaching".
Comparing with the content provided by Mr. T.H. T, the time spent on assignment at the educational institution is counted as the time spent working in the education sector. However, when proposing to be awarded the title of Meritorious Teacher, individuals need to provide specific evidence of the assignment decision and receiving the assignment of tasks from the competent authority for consideration and decision.
Standards for considering the title of Meritorious Teacher
Point d, Clause 3, Article 8 of Decree No. 35/2024/ND-CP dated April 2, 2024 of the Government on considering awarding the titles "People's Teacher", "Excellent Teacher" stipulates:
Teachers, management staff at higher education institutions, and educational research staff meet the following standards:
Head of 1 national-level science and technology task that has been accepted from the achieved level or higher, or head of 2 provincial and ministry-level science and technology tasks that have been accepted from the achieved level or higher.
The author of 10 scientific articles, editor-in-chief of 1 textbook, and guide of 2 research students successfully defended their doctoral dissertation".
Comparing the above regulations, there is not enough information to determine whether the teacher currently working at the National Defense and Security Education Center mentioned by Mr. T is currently working at the National Defense and Security Education Center under the management of which managing unit to verify whether he is eligible for the title of People's Teacher - Meritorious Teacher or not (university education institution or unit under the Ministry of National Defense); the job position is teacher or management official,... according to the assignment decision?
Therefore, it has not been determined whether it is the object affected by point d, clause 3, Article 8 of Decree No. 35/2024/ND-CP or not.
Subjects eligible for consideration for the title of Meritorious Teacher, the criteria that can be converted to equivalent achievements are specified in Appendix 1 of Decree No. 35/2024/ND-CP.
