Recently, the Ministry of Education and Training has received many questions from teachers related to the payment of overtime teaching salaries. Including the question of Mr. Hoang Tu (Lao Cai).
Mr. Tu said that in the 2024-2025 school year, his school was assigned 26/26 teachers by the District People's Committee, but not enough according to the department structure, including English. Therefore, during the school year, he taught 105 periods exceeding the norm.
Mr. Tu asked, is your case eligible for overtime teaching regime according to Circular No. 07/2013/TT-BGDDT?
Regarding this issue, the Ministry of Education and Training responded as follows:
According to the provisions of Clause 6, Article 3 of Joint Circular No. 07/2013/TTLT-BGDDT-BNV-BTC dated March 8, 2013 of the Minister of Education and Training, the Minister of Home Affairs and the Minister of Finance guiding the implementation of the overtime salary regime for teachers in public educational institutions,:
"Only pay for overtime teaching salaries in units or subjects with less than the number of teachers approved by competent authorities. Units or departments that do not lack teachers are only paid for overtime teaching wages when there are teachers on sick leave, maternity leave according to the provisions of the Law on Social Insurance or going to study, receive training, participate in inspection teams, inspect and participate in other work (hereinafter referred to as going to work on other tasks) assigned or transferred by competent authorities and must arrange other teachers to teach instead".
Therefore, based on the provisions of Joint Circular No. 07/2013/TTLT-BGDDT-BNV-BTC, the Ministry of Education and Training requests Mr. Hoang Tu to report to the management agency for detailed instructions.
