The draft Law on Teachers is being consulted by the Ministry of Education and Training and is expected to be submitted to the National Assembly for discussion and comments at the October 2024 session.
The draft Law was drafted by the Ministry of Education and Training (in coordination with ministries, departments, and branches) to regulate almost all issues related to teachers, from concepts to working regimes, rest, recruitment, retirement, salary policies, allowances, etc.
According to current regulations, teachers are divided into grades I, II, III, applicable to teachers who are civil servants in public service units. Corresponding to the grades, teachers will have different salary levels.
However, the Draft Law on Teachers (3rd time) no longer mentions grades I, II, III in professional titles.
Article 14 of the draft Law on Teachers stipulates: Teacher titles include: Preschool teachers, primary school teachers, junior high school teachers, high school teachers, pre-university teachers, continuing education teachers, vocational education teachers, college lecturers, vocational education lecturers, university lecturers.
Each teacher title is classified as follows:
Teacher, master teacher, senior teacher;
Teaching assistant, lecturer, senior lecturer, senior lecturer (including professor, associate professor).
The title of teacher is the basis for education and training management agencies and educational institutions to determine job positions and number of employees; to recruit, use, manage and implement regimes and policies on treatment and honor for teachers.
The appointment and transfer of teaching titles are carried out as follows:
Teachers are appointed to the position of teacher, lecturer or teaching assistant after being recruited according to regulations;
Teachers are appointed to the next higher title rank when they are assessed to meet the standards of the next higher title rank they are holding;
People with extensive experience in teaching and education and many achievements in professional activities will be specially considered by educational institutions for appointment to a higher position;
Teachers of higher education institutions who are considered to meet the standards and are appointed to the titles of professor and associate professor according to the provisions of the Law on Education shall be specially appointed to the title of senior lecturer;
In case a teacher transfers to another educational institution and the title he/she is holding is not suitable for the job position at the new educational institution, he/she will be considered for a title change.
Thus, in the Draft Law on Teachers, the Ministry of Education and Training is proposing that teachers will no longer be divided into grades I, II, III, but instead, teachers will be divided according to their professional titles and each teacher title will be classified into: Teacher, main teacher, senior teacher; Teaching assistant, lecturer, main lecturer, senior lecturer (including professor, associate professor).
