The Ministry of Education and Training (MOET) is drafting a Circular amending and supplementing a number of articles of Circulars regulating professional standards, appointment of titles and salary ranking for teachers in educational institutions.
Standardizing title ranks and codes for teachers holding the same job position
According to the Draft Circular, the salary coefficient is maintained at the current level for cases that do not meet the standard level of training; or apply a salary scale corresponding to the training level requirements as prescribed in Decree No. 204/2004/ND-CP for cases that reach college level teaching specialized subjects as prescribed in Article 20 of Decree No. 93/2026/ND-CP.
For cases of teachers teaching specialized subjects as mentioned above, the draft Circular supplements regulations on appointing teachers of grade III and applying the salary coefficient of civil servants of type A0 (from salary coefficient 2.10 to 4.89) for primary school, secondary school, high school and continuing education teachers with college degrees who are recruited to teach specialized subjects such as Informatics, Foreign Languages, Arts, ethnic minority languages.
When teachers have a bachelor's degree or higher and ensure meeting the training and fostering standards according to regulations, the salary coefficient of civil servant type A1 (from 2.34 to 4.98) is applied.
The Ministry believes that this regulation aims to improve the legal basis for salary ranking for teachers with college degrees recruited to teach specialized subjects; ensure consistency between regulations on training and fostering standards, teacher titles and salary regimes. This is also a mechanism to encourage teachers to continue studying, improve their training qualifications, contributing to improving the quality of the teaching staff.
Supplementing detailed guidance for cases where reappointment is required
The draft Circular clearly states that the subjects of re-appointment and salary reclassification are those who are immediately appointed to high-ranking positions (from November 3, 2015 to March 20, 2021) after the probation period expires or after achieving a training level higher than the prescribed level but have not been admitted in the exam or promotion consideration organized by competent authorities (including cases of recruitment before November 3, 2015 and completing the probation period as prescribed after November 3, 2015).
The draft also stipulates that cases of re-appointment and salary rearrangement do not include cases of high-ranking appointments when recruiting and receiving according to policies to attract and create a source of cadres from excellent graduates, young scientific cadres, policies to attract and value talented people according to the provisions of law or specific policies of localities and educational institutions at the time of recruitment and reception, and cases of rank appointments after raising the standard level of training.
The draft Circular proposes two options for re-appointing professional titles and re-arranging salaries. Each option clearly states each subject of application, specific conditions and principles to ensure compliance with the provisions of the Law on Teachers, the Law on Civil Servants on title appointment, and compliance with teacher professional standards issued by the Ministry of Education and Training.
Overcoming the situation of limiting the number of teachers being transferred from the old rank to the corresponding rank
The draft Circular stipulates the appointment of teacher titles in preschool, general education, and continuing education institutions from old regulations to new titles corresponding to the provisions of law, not based on the structure of professional title ranks.
Before the Circular takes effect, teachers who have to be appointed to lower ranks due to the structure of professional title ranks will be re-appointed to the rank they held from the date the Circular takes effect. These cases are entitled to retroactively receive salary and allowance differences compared to the level paid.
The Ministry stated the reality that some localities have based on the proportion of professional title ranks later to limit the number of teachers appointed from old rank II to new rank II, especially for primary and secondary schools.
Therefore, the addition of this regulation aims to overcome the situation where some localities apply the professional title rank structure (of promotion) to limit the number of teachers being transferred from the old rank to the corresponding rank according to new regulations, ensuring that the transfer is carried out in accordance with the nature of the corresponding transfer process, ensuring the legitimate rights and interests of teachers, and overcoming the obstacles and inadequacies arising in the process of organization and implementation in the past time.
