According to the session agenda, in the third working week of the 8th Session (from November 4-9), the National Assembly will discuss the draft Law on Teachers.
The draft Law on Teachers submitted to the National Assembly for comments for the first time has many new points compared to the drafts previously published by the Ministry of Education and Training for comments.
Accordingly, teachers' salaries are ranked highest in the administrative career salary scale system; have priority in salary and allowance regimes higher than other teachers for preschool teachers; work in particularly difficult areas of ethnic minorities, mountainous areas, coastal areas and islands; specialized schools, other specialized schools; implement inclusive education; are ethnic minorities and teachers in some specific professions; Teachers recruited and ranked for the first time are ranked 1 salary level higher in the administrative career salary scale system...
In addition, the Draft Law on Teachers submitted to the National Assembly for first comments also stipulates the retirement regime for teachers.
Article 30 of the draft stipulates: The retirement age of teachers shall comply with the provisions of the Labor Code and relevant legal provisions, except for the case specified in Clause 2 of this Article.
Teachers in preschools, if they wish, can retire at a lower age but not more than 5 years older than the regulations and will not have their pension rate deducted due to early retirement.
Thus, compared to previously published drafts of the Law on Teachers, the case of teachers teaching at schools for children with disabilities was not included in the draft Law on Teachers to propose early retirement 5 years as in previously published drafts.
Previously, in the draft Law on Teachers (3rd time), the retirement age of teachers was proposed by the Ministry of Education and Training as follows:
1. The retirement age of teachers shall comply with the provisions of the Labor Code, except for the case specified in Clause 2 of this Article.
2. Teachers teaching at schools for the disabled; teachers with reduced working capacity; teachers teaching practical work in occupations listed as arduous, toxic, dangerous or especially arduous, toxic, dangerous as prescribed by law; teachers working in areas with particularly difficult socio-economic conditions may retire at a lower age but not more than 5 (five) years older than the prescribed age and shall not have their pension rate deducted due to early retirement.
3. 6 (six) months before the teacher's retirement date, the agency, organization, or unit managing the teacher must notify in writing about the retirement date; 3 (three) months before the teacher's retirement date, the agency, organization, or unit managing the teacher must issue a retirement decision.
4. Educational institutions may sign fixed-term contracts with pensioners if the institution has a need and the pensioner wishes.
