The Government has just issued Decree No. 93/2026/ND-CP detailing and guiding the implementation of a number of articles of the Law on Teachers.
Article 18 of the Decree stipulates the process and procedures for retiring at a higher age.
Specifically, every year, public educational institutions, based on development orientations, the organization's human resource situation and job position requirements, announce policies and the need to use retired teachers at a higher age.
Dossiers requesting retirement at a higher age include: Application for retirement at a higher age (according to Form No. 02 in the Appendix attached to this Decree); Teacher's dossier according to the provisions of the law on public employees; Documents and evidence meeting the conditions for retirement at a higher age.
Teachers who meet the conditions according to regulations send 1 set of dossiers directly at a public educational institution or online through the information system, public service portal of the public educational institution (if any) at least 6 months before retirement.
Within 30 working days from the date of receiving complete and valid dossiers, public educational institutions shall consider and evaluate the conditions of teachers who wish to retire at a higher age and the policies and needs of public educational institutions to consider and decide on retirement at a higher age, and the retirement time at a higher age for each case of teachers.
In case of disagreement to extend the working time, the public educational institution shall respond in writing to the teacher and clearly state the reason.
Decisions on retirement at a higher age for teachers are sent to relevant organizations and individuals at least 3 months before retirement and are updated in the teacher's electronic records according to regulations.
Based on the decision to retire at a higher age of the teacher, public educational institutions shall sign a written agreement or appendix to the working contract with the teacher on regimes and policies for teachers according to the provisions of law.
Teachers can change their retirement age to a maximum of 10 years
Article 27 of the Law on Teachers stipulates the retirement regime at a higher age for teachers in public educational institutions as follows:
Subjects who can enjoy retirement benefits at a higher age include teachers with professor, associate professor titles or doctoral degrees and teachers working in specialized and specific industries and fields.
The retirement regime at a higher age is implemented when the educational institution has a need; teachers are healthy enough, voluntary and meet the standards and conditions of the educational institution.
The retirement age at a higher age is regulated as follows:
Not over 5 years old for teachers with a doctorate degree;
Not over 7 years old for teachers holding the title of associate professor;
Not over 10 years old for teachers holding the title of professor.
During the period of implementing the retirement regime at a higher age as prescribed in Clause 3 of this Article, teachers do not hold management positions.
The Government regulates only the process and procedures for retiring at a higher age; retiring at a higher age for teachers in specialized and specific industries and fields.
Retirement at a higher age for teachers working in specialized industries and fields
Decree No. 93/2026/ND-CP stipulates the retirement at a higher age for teachers working in specialized and specific industries and fields as follows:
For teachers working in specialized industries and fields belonging to the fields of health, culture, arts, physical education, and sports, in cases where they do not have professor or associate professor titles or do not have a doctorate degree but have professional qualifications and nghiệp vụ suitable to the specific characteristics of the industry or field, they may be entitled to retirement benefits at a higher age.
The retirement age at a higher age for teachers in specialized and specific fields in the fields of health, culture, arts, physical education, and sports is no more than 5 years old.
The Minister of Health, the Minister of Culture, Sports and Tourism shall specify the requirements for subjects, standards, and conditions for teachers entitled to retirement at a higher age according to the provisions of this Article.
