Circular 29 of the Ministry of Education and Training (MOET) regulating extra teaching and learning takes effect from February 14.
The Circular stipulates that extra teaching is not organized for primary school students, except for cases of training in arts, physical education, and life skills training.
For extracurricular teaching, individuals and extracurricular teaching organizations must register for business and publicize information about tuition fees, duration, subjects, time, and location. Along with that, teachers are not allowed to collect extra teaching fees from students in their class. Teachers who are civil servants - those who are recruited according to job positions and work in public schools, will also be handled according to Articles 15 and 16 of Decree 112/2020/ND-CP of the Government on disciplinary measures against civil servants.
Accordingly, civil servants who do not hold management positions will be subject to disciplinary measures such as reprimand, warning and forced to quit their jobs. In addition to the above instructions, civil servants who are holding management positions may also be dismissed from their positions.
In addition, according to Article 19 of Decree 112/2020/ND-CP, the form of disciplinary action for forced resignation applies to civil servants who commit violations in one of the following cases:
1. Having been disciplined by dismissal from office for management officials or warning for officials who do not hold management positions but re-offend;
2. Committing a first-time violation, causing particularly serious consequences in one of the cases specified in Article 16 of this Decree;
3. Management officials who commit a first-time violation, causing very serious or especially serious consequences in one of the cases specified in Clause 3, Article 17 of this Decree;
4. Using fake or illegal degrees, certificates, certificates, and certificates to be recruited into agencies, organizations, or units;
5. Drug addiction; in this case, there must be confirmation from the medical facility or a notice from the competent authority.
Thus, if there are serious violations or repeated violations, teachers may face the form of forced resignation.
The head of the unit will base on the level of violation to issue a decision on appropriate disciplinary action against teachers who have additional teaching behavior that is not in accordance with regulations. In addition, some cases of teachers may also be restricted from performing professional activities according to the provisions of relevant laws.
Regarding the penalty level, according to Article 7 of Decree 138/2013/ND-CP of the Government regulating administrative sanctions in the field of education, the penalty level for violations of regulations on tutoring is: Fine 1-2 million VND for the act of organizing tutoring activities that do not ensure facilities as prescribed;
Fine 2-4 million VND for organizing additional teaching activities for the wrong subjects;
Fine 4-6 million VND for organizing extra teaching activities that are not in accordance with licensed content; Fine 6-12 million VND for organizing extra teaching activities without a license.
Depending on the level, violators will also be subject to additional penalties such as: revoking the right to use the teaching license for an additional 6-12 months if organizing additional teaching activities that are not for the right subjects or not in accordance with the licensed content; Suspending additional teaching activities for 12-24 months if organizing additional teaching activities without a license.
