Answering readers of Lao Dong Newspaper, Lawyer Diep Nang Binh - Head of Tinh thong luat Law Office (Ho Chi Minh City Bar Association) said that the issue that many teachers are concerned about today is whether when they are eligible for early retirement due to arrangement, will teachers be deducted the pension benefit rate due to early retirement and in which cases is it guaranteed not to be deducted the pension benefit rate?
Based on Clause 2, Article 7 of Decree 178/2024/ND-CP (amended by Clause 6, Article 1 of Decree 67/2025/ND-CP), accordingly, the conditions for enjoying the policy of early retirement according to the working time with compulsory social insurance (BHXH) contributions and the number of early retirement years if they belong to the subjects in Clauses 1 and 3, Article 2 of Decree 178/2024/ND-CP will not be deducted from the pension rate, even if they retire early from 02 to 10 years compared to the retirement age according to regulations.
Specifically, there are four groups of subjects below who will not be deducted from the pension rate if they meet the conditions on age, social insurance contribution period and job characteristics:
Having an age of 02 to 05 years compared to the retirement age specified in Appendix I issued together with Decree No. 135/2020/ND-CP, having sufficient working time and meeting the conditions for enjoying pensions according to social insurance regulations.
Having a lifespan of more than 05 to less than 10 years compared to the retirement age specified in Appendix I issued together with Decree No. 135/2020/ND-CP, is eligible to receive a pension according to social insurance regulations.
Having an age of 02 to 05 years compared to the retirement age specified in Appendix II issued together with Decree No. 135/2020/ND-CP, having sufficient working time and sufficient conditions to receive pensions according to social insurance regulations and having worked for 15 years or more in hazardous, heavy, dangerous or extremely difficult occupations.
Having an age of less than 02 to retirement age specified in Appendix II issued together with Decree No. 135/2020/ND-CP, having sufficient working time and sufficient conditions to receive a pension according to social insurance regulations and having worked for 15 years or more in hazardous, heavy, dangerous or extremely difficult occupations.
