Teachers wonder about summer vacation pay
On September 3, the Ministry of Finance's electronic information portal also posted questions from two teachers related to the payment of summer vacation leave.
A secondary school teacher working in a difficult commune, receiving a regional allowance with a coefficient of 0.5, said that he was previously paid summer vacation benefits according to Circular 141/2011/TT-BTC.
This person wondered if he, as an education official, is eligible for the above regulations and is he currently still entitled to annual leave pay benefits.
Another case is a teacher working in Muong Khuong commune, Lao Cai province. This person said that they have 2 months of summer vacation each year and are paid for leave.
This teacher registered for summer vacation in her hometown in Thanh Ba, Phu Tho and asked if this year she will still be paid for summer vacation as in previous years.
According to the content of the answers posted on the Financial Policy Q&A Portal, previously the Ministry of Finance issued Circular 141/2011/TT-BTC, then amended and supplemented by Circular 57/2014/TT-BTC, stipulating the annual leave regime for cadres, civil servants, public employees and contract workers working in state agencies and public non-business units.
These regulations mention two items including payment for train and bus fares on annual leave and payment for salaries or allowances for days of annual leave but not yet taken or not fully taken.
Circular 141 previously also defined the scope of application as including cadres, civil servants, public employees and contract workers, then used the general abbreviation "cadres, civil servants".
However, according to feedback on the Financial Policy Q&A Portal, the 2019 Labor Code has replaced the 2012 Labor Code and removed the regulation on train and bus fares when taking annual leave as previously based.
For salaries for annual leave days that have not been taken or have not been fully taken, the current implementation is based on the provisions of current law on cadres, civil servants and public employees.
The reply agency said that agencies and units are currently not implementing Circular 141/2011/TT-BTC and Circular 57/2014/TT-BTC. The Ministry of Finance is implementing the abolition of these two circulars according to the provisions of the Law on Promulgation of Legal Documents.
Teachers have 8 weeks of summer vacation, including annual leave
For civil servants, the 2025 Law on Civil Servants stipulates that civil servants are entitled to annual leave, holidays, Tet holidays, personal leave and unpaid leave according to labor law.
In case due to work requirements, public employees do not use or do not use up the annual leave days, they are paid a sum of money for the non-recovery days. Payment is based on internal spending regulations and the financial capacity of the unit.
Specifically for teachers, Article 3 of Decree 84/2020/ND-CP stipulates that the annual summer vacation time for teachers at preschool, general education and specialized schools is 8 weeks, including annual leave time.
In addition to summer vacation, teachers are also entitled to holidays, Tet and other days off according to the provisions of the Labor Code.
Therefore, for the two cases mentioned above, the reply agency requests teachers to implement the leave regime according to current regulations and guiding documents of the Education Law, instead of continuing to apply the mechanism in Circular 141/2011/TT-BTC and Circular 57/2014/TT-BTC as before.
