This regulation is based on Article 23 of the 2025 Law on Teachers. Specifically, Clause 2 clearly states: "The salary of teachers in non-public educational institutions shall be implemented in accordance with the provisions of the law on labor". This means that from 2026, non-public teachers will be paid at least equal to the regional minimum wage prescribed by the Government.
According to Article 91 of the 2019 Labor Code, the minimum wage is the lowest level paid to employees doing the simplest work under normal conditions, to ensure a minimum living standard for themselves and their families. The minimum wage is determined by region, calculated monthly or hourly, and is adjusted based on many factors such as living standards, labor supply-demand relations, consumer price index, economic growth rate and ability to pay of enterprises.
From January 1, 2026, the floor salary of non-public teachers will be calculated according to the regional minimum wage, creating a clearer legal basis for salary payment, while ensuring the minimum rights of teachers in non-public schools.
In the draft Decree regulating the minimum wage for employees working under labor contracts from January 1, 2026, the new regional minimum wage will be:
