On July 11, information from the Department of Education and Training of Nghe An province said that the provincial education sector has developed and submitted a draft Decision promulgating the Regulation on mobilization and transfer of teachers and teachers holding management positions in public preschool, general education, and continuing education institutions in the area to collect comments.
According to the draft, the mobilization of teachers is implemented to rearrange the staff after arranging educational institutions; solve the situation of teacher surplus and shortage; support improving the quality of teaching, management or meeting the professional requirements of educational management agencies.
Subjects that may be considered for transfer include teachers who are redundant staff due to changes in the scale of schools, classes, and subjects; teachers who voluntarily work in ethnic minority areas, mountainous areas, or areas with particularly difficult socio-economic conditions.
Teachers with good professional and nghiệp vụ capacity, a lot of teaching and management experience; management staff who are planned, appointed or need to be rearranged according to task requirements are also eligible for transfer.
The selection of teachers for transfer is expected to be considered in order. First, teachers of subjects that are surplus and do not meet the teaching norms; then, people who have never been transferred, assigned, or have less transfer time.
The next criteria include age, number of years of service, gender and whether teachers are concurrently in charge of mass organizations and professional groups.
The mobilization period is no more than 2 years for female teachers and no more than 3 years for male teachers. In some special cases, teachers may be considered to return to their units before the deadline.
The draft stipulates that no transfer is carried out for female teachers who are pregnant or raising children under 36 months old; teachers in particularly difficult circumstances and some other cases as prescribed.
For transfer, teachers must have a wish, with the consent of the educational institution where they are transferred and the place of reception, and at the same time be suitable for the job position and staff structure of the unit.
Teachers who are being considered for disciplinary action; who are being inspected, verified, inspected, investigated, prosecuted, or have not yet worked for 3 years from the date of recruitment will not be considered for transfer.
The regulations on minimum working hours do not apply to teachers who voluntarily transfer to educational institutions in ethnic minority areas, mountainous areas, border areas or areas with particularly difficult socio-economic conditions.
According to the draft, the Chairman of the Commune-level People's Committee has the authority to mobilize and transfer teachers and management officials between educational institutions under its management.
The Director of the Department of Education and Training shall carry out the transfer and relocation between educational institutions under 2 different commune-level administrative units or between commune-level units and educational institutions under the management authority of the province.
The Nghe An education sector determines that the mobilization and transfer must be carried out publicly, transparently, objectively and in accordance with regulations; not to be used to cause difficulties, discrimination or affect the legitimate rights and interests of teachers.
After receiving comments and completion, the draft will be submitted to competent authorities for consideration and promulgation.
