How are the rights and obligations of teachers regulated from January 1, 2026?
Pursuant to Article 8 of the 2025 Law on Teachers, the rights of teachers are stipulated as follows:
Teachers in public educational institutions exercise the rights according to the provisions of the law on civil servants and other relevant legal provisions. Teachers in non-public educational institutions exercise their rights according to the provisions of the law on labor and other relevant legal provisions.
In addition to the provisions of Clause 1, Article 8 of the 2025 Law on Teachers, teachers also have the following rights:
To be taught and educated in accordance with training expertise; proactively distribute time and arrange content according to educational programs; select and use documents and learning materials for teaching and education activities; comment, evaluate, participate in rewarding and disciplining learners according to the provisions of law, regulations on organization and operation of educational institutions
Be able to conduct scientific research and transfer scientific research products, enjoy preferential policies in scientific research activities; participate in the management and operation of enterprises established by higher education institutions, operating in the fields of scientific development, innovation, application and technology transfer according to the provisions of law.
To be respected and have their reputation, honor and dignity protected; to be treated equally in their activities and career development.
Take summer vacation and other holidays as prescribed by law.
Being trained and fostered to improve qualifications.
To participate in teaching and scientific research at other agencies, organizations and units according to the provisions of law, regulations on organization and operation of educational institutions.
In addition, Article 9 of the Law on Teachers also stipulates the obligations of teachers as follows:
Teachers in public educational institutions perform obligations according to the provisions of the law on civil servants and other relevant legal provisions. Teachers in non-public educational institutions shall fulfill their obligations according to the provisions of the law on labor and other relevant legal provisions.
In addition to the above regulation, teachers also have the following obligations:
Teach and educate according to educational goals and principles; fully and qualitatively implement educational programs;
Maintain the qualities, reputation, honor, dignity, and ethics of teachers; set an example in professional activities and behavior in social relations; ensure academic integrity;
Promote the qualities, abilities and discover and nurture the talents of learners;
Respect, treat fairly, protect the legitimate and legal rights and interests of learners;
Carry out the task of scientific research; research and apply educational science; update and improve practical skills, access new technologies according to the provisions of law;
Participating in building a safe, democratic, innovative and creative educational environment.
What is the standard training level for teachers?
Pursuant to Article 72 of the 2019 Education Law, the standard training level of teachers is regulated, specifically as follows:
Have a teaching college degree or higher for preschool teachers;
Have a bachelor's degree in teacher training or higher for primary, secondary and high school teachers;
In case there are not enough teachers with a bachelor's degree in teacher training, they must have a bachelor's degree in a suitable major and a certificate of pedagogical training;
Have a master's degree for teachers teaching at university level; have a doctorate degree for teachers teaching and guiding master's theses and doctoral theses;
The standard training level of teachers teaching in vocational training institutions is implemented according to the provisions of the Law on Vocational Education.
