The contents of salary, allowance, summer vacation, etc. are always of interest to teachers across the country. Recently, there have been many questions sent to the Ministry of Education and Training, including the question of Ms. Ha Thi Nhan (Dong Nai) about the regulation of summer vacation for preschool teachers.
Ms. Ha Thi Nhan said that Point a, Clause 1, Article 3 of Decree No. 84/2020/ND-CP stipulates that the annual summer vacation for teachers at preschools, general education institutions, and specialized schools is 8 weeks, including annual leave.
Clause 2, Article 3 of Circular No. 48/2011/TT-BGDDT stipulates: "2. The annual leave for preschool teachers includes: summer vacation and other holidays, specifically as follows: a) Teachers' summer vacation is 08 weeks, with full salary and allowances and subsidies (if any); b) Other days off are implemented according to the provisions of the Labor Code and current regulations".
Ms. Nhan said that Circular No. 48/2011/TT-BGDDT stipulates that teachers' summer vacation is 8 weeks and the annual leave is 12 days. For Decree No. 84/2020/ND-CP, teachers' summer vacation includes 12 annual leave days. Ms. Nhan asked, what regulations must preschool teachers follow?
The Ministry of Education and Training responds to this issue as follows:
According to the provisions of Clause 3, Article 58 of the Law on Promulgation of Legal Documents No. 64/2025/QH15 dated February 19, 2025, in case the legal documents have different provisions on the same issue, the document with higher legal effect will be applied.
Therefore, the summer vacation for preschool teachers is implemented according to the provisions of Point a, Clause 1, Article 3 of Decree No. 84/2020/ND-CP dated July 17, 2020 of the Government detailing a number of articles of the Law on Education. Specifically, the summer vacation for preschool teachers is 8 weeks, including annual leave.
