The Government has just issued Decree No. 93/2026/ND-CP detailing and guiding the implementation of a number of articles of the Law on Teachers. Among them, noteworthy are regulations related to teachers' summer vacation time.
This Decree takes effect from the date of signing (March 31, 2026).
Article 17 of the Decree stipulates the summer vacation time for teachers.
Accordingly, the annual summer vacation time for teachers in preschool education institutions, general education institutions, specialized schools is 8 weeks, including annual leave;
The annual summer vacation time of teachers in continuing education institutions is at least 4 weeks, maximum 8 weeks, including annual leave;
The annual summer vacation time for teachers in pre-university schools is 8 weeks, including annual leave;
The annual summer vacation time for teachers teaching vocational secondary education programs, teaching intermediate level and teaching college level is 6 weeks; for teachers teaching elementary level is 4 weeks, including annual leaves;
The annual summer vacation of teachers in higher education institutions, political schools and training and fostering institutions is implemented according to the regulations on organization and operation of educational institutions;
In case of emergencies, emergency to prevent natural disasters, epidemics or urgent cases, the summer vacation time of teachers specified in points a, b of this clause shall be decided by the Minister of Education and Training according to his authority; the summer vacation time of teachers specified in points c, d, đ of this clause shall be decided by the head of the educational institution;
Also according to the provisions of Article 17, during summer vacation, teachers are entitled to full salary and allowances according to regulations.
In addition to the summer vacation period as prescribed in Clause 1 of this Article, teachers are entitled to holidays, Tet and other days off as prescribed by the Labor Code.
Based on the school year time plan issued by the Ministry of Education and Training and the specific conditions of the locality, the Chairman of the Provincial People's Committee decides the summer vacation time for teachers in preschool education institutions, general education institutions, continuing education institutions, specialized schools in the area.
Based on the provisions of points c, d and d of clause 1 of this Article, the head of a higher education institution, a vocational education institution, a vocational education center, a university preparatory school, a political school and a training and fostering institution decides the summer time of the teacher in accordance with the training plan and specific conditions of each educational institution.
The summer vacation of teachers in educational institutions under the Ministry of National Defense and the Ministry of Public Security is implemented according to the regulations of the Minister of National Defense and the Minister of Public Security.
