Voters in Thanh Hoa province, based on the content of Resolution No. 35/NQ-CP dated June 4, 2019 of the Government on increasing the mobilization of social resources to invest in the development of education and training in the period of 2019 - 2025, have proposed that the Government study and promulgate regulations to support the non-public school system in 2 contents.
First, it is recommended to support teaching equipment and equipment for non-public schools such as public educational institutions to encourage and facilitate the development of non-public schools;
Second, there are specific regulations on joint ventures and associations of educational and training institutions to implement the content of the viewpoint stated in the Resolution, which is to "encourage public educational and training institutions to cooperate, joint ventures and associations with non-public institutions".
Responding to voters, regarding the first issue, the Ministry of Education and Training said that currently, support for teaching equipment and equipment for public schools is being implemented by investing in procurement from the state budget.
According to the State Budget Law, non-public schools are not subject to the law, so "issuing regulations on supporting teaching equipment and equipment for non-public schools such as public educational institutions to encourage and facilitate the development of non-public schools" is not in accordance with the State Budget Law.
In addition, Decree No. 81/2021/ND-CP dated August 27, 2021 of the Government regulating the mechanism for collecting and managing tuition fees for educational institutions in the national education system and policies on tuition exemption and reduction, support for study costs; service prices in the field of education and training allow non-public educational institutions to "are allowed to proactively develop tuition fees and prices for other services in the field of education and training (except for services assessed by the State) to ensure cost compensation and have reasonable accumulation, be responsible for publicity, and explain to learners and society about tuition fees and prices of services decided by themselves".
While public schools are only allowed to determine tuition fees according to state regulations. With this policy, it has created fairness while encouraging and creating conditions for the development of non-public schools.
Regarding the second content, the Ministry of Education and Training believes that currently, regulations on policies to encourage socialization for establishments implementing socialization in the field of education and training (including preferential policies on land lease, lease, construction of facilities, registration fee incentives, value added tax, import-export tax, corporate income tax; preferential credit policies, capital mobilization, etc.) have been specifically regulated in Decree No. 69/2008/ND-CP dated May 30, 2008 of the Government on policies to encourage socialization for activities in the fields of education, vocational training, health, culture, sports, environment and amended and supplemented in Decree No. 59/2014/ND-CP dated June 16, 2014 of the Government. The Ministry of Finance is the agency in charge of proposing to amend and supplement Decree No. 69/2008/ND-CP to be submitted to the Government for promulgation. The Ministry of Education and Training has issued Official Letter No. 5040/BGDDT-PC dated November 4, 2019 to the Ministry of Finance for comments on the draft Decree amending and supplementing a number of articles of Decree No. 69/2008/ND-CP. Currently, the Ministry of Finance is synthesizing opinions from ministries, branches and localities to complete the draft.
