The Government Office has just issued Official Letter No. 9014 dated September 23 on investment in the Phan Thiet Airport project - Civil Aviation Category.
According to this document, considering the proposal of Lam Dong Provincial People's Committee on the policy of terminating the form of BOT investment under the Law on Investment under the Public-private Partnership (PPP) method, switching to the form of investment under the Law on Investment for Phan Thiet Airport project - Civil Aviation category.
Based on current legal regulations, Deputy Prime Minister Tran Hong Ha commented: The authority to terminate the project contract, the authority to decide on the investment policy, and adjust the investment policy for the Phan Thiet Airport project (civil aviation category) is the People's Council and the People's Committee of Lam Dong province.
Therefore, Lam Dong Provincial People's Committee will base on legal regulations to terminate the project contract, approve the investment policy, approve the adjustment of the investment policy of this project according to its authority, and comply with legal regulations.
Deputy Prime Minister Tran Hong Ha assigned the Ministry of Finance and the Ministry of Construction, according to their assigned functions and tasks, to coordinate and guide the People's Committee of Lam Dong province in the implementation process.
Phan Thiet airport started construction in January 2015. According to the approved Planning, the project consists of 2 items: military airport and civil airport. Currently, the military item built by the Air Defense - Air Force has been basically completed and put into operation.
The civil items under the form of BOT contracts are in the process of adjusting the investment policy (increasing the scale from level 4C to 4E) and selecting a replacement investor.
Due to the adjustment of the project scale and increase in total investment, the investment policy must be adjusted according to regulations.
After completing the procedures, on September 20, 2024, the People's Committee of Binh Thuan province (before the merger) submitted Document 3513 to the Prime Minister on approving the adjustment of the investment policy and terminating the contract before the deadline of the Phan Thiet Airport project, civil item under the form of a BOT contract with the old investor.
The Provincial People's Committee is waiting for relevant agencies to review and advise the Prime Minister to consider adjusting and approving the above content.
Up to now, according to current regulations, the authority to approve this content belongs to the People's Council and People's Committee of Lam Dong province.
Previously, in mid-July 2025, a company sent a document to the Office of Lam Dong Provincial People's Committee regarding interest and request for investment in civil items of Phan Thiet Airport Project.
The Chairman of Lam Dong Provincial People's Committee has issued a document assigning the Department of Finance to preside over and coordinate with the province's specialized agencies to study, review and organize the appraisal of investors' reports. On that basis, advise the Provincial People's Committee to consider and resolve the proposals of this company in accordance with the provisions of law.
