Ministry of Industry and Trade states reasons why rooftop solar power installation must be notified 10 days in advance

Regulations requiring notification before installing self-produced and self-consuming rooftop solar power, connected to national electricity, are necessary to assess the possibility of overloading.

According to the Government Electronic Information Portal, Mr. Nhat Hoa (An Giang) said that the regulation on the time to notify 10 days in advance for solar power systems has newly generated many risks in commerce when the investor requests the construction unit to complete the notification procedures before signing the contract.

This leads to the risk of unhealthy competition such as: Investors changing construction units or buying materials themselves after the consulting unit has supported completing procedures; risk of leaking customer registration information while waiting for feedback from the dossier receiving agency; arising acts of harassment, suggesting changes of equipment suppliers or construction units.

Regarding this issue, the Ministry of Industry and Trade has the following opinions:

For self-produced and self-consumed rooftop solar power sources connected to the national power system, the regulation that notifications must be sent at least 10 working days before the installation date of the power source is suitable for practice, ensuring time for electricity units to assess the possibility of overloading the power grid in the power source development area connected to the power grid.

This regulation is necessary to manage the development of power sources to ensure compliance with the ability to connect, operate the power grid safely and regulate the power system.

In addition, the procedures and components of the dossier for announcing power source development specified in Decree No. 58/2025/ND-CP (unified in the Consolidated Document No. 52/VBHN-BCT dated June 30, 2026) have been simplified to the maximum to create favorable conditions for organizations and individuals to implement.

The occurrence of trade risks and unfair competition between organizations and individuals within the scope of regulation of civil and commercial laws and other relevant laws, not within the scope of regulation of electricity laws.

It is proposed that organizations and individuals study legal regulations on civil and commercial matters to negotiate and sign contracts to provide services, ensuring the legitimate rights, obligations and interests of the parties in accordance with the law.
