On November 25, the People's Court of Khanh Hoa province issued a decision to open bankruptcy proceedings against Cam Ranh Shipbuilding Company Limited (Km3, National Highway 1, Cam Phu Ward, Cam Ranh City, Khanh Hoa Province).
Within 30 days, creditors must send debt collection notices to the People's Court of Khanh Hoa province to carry out procedures according to the provisions of law, except in cases of force majeure or objective obstacles according to Clause 4, Article 66 of the Bankruptcy Law 2014.
For debts, the creditor must clearly state on the debt claim the total amount of debt payable, including: the debt, the amount of debt due, the amount of interest due but not yet paid; the amount of debt not yet due; the amount of secured debt and the method of security; the amount of unsecured debt that Cam Ranh Shipbuilding Company Limited (hereinafter referred to as Cam Ranh Shipbuilding Company) must pay; the amount of compensation according to the contract (if any). Attached are documents and evidence proving the debt. The debt claim must be signed by the creditor or the creditor's legal representative.
Cam Ranh Shipbuilding Company currently owes Social Insurance more than 28 billion VND from July 2016 to present for 57 employees. The production, business, financial and material situation of the enterprises in recent times has been extremely difficult, unable to recover and has fallen into a state of prolonged bankruptcy.
According to the Government's policy in Resolution No. 220/NQ-CP dated December 22, 2023, Cam Ranh Shipbuilding Company is among the companies that must urgently review and complete documents and procedures according to legal regulations to submit a request to open bankruptcy proceedings.
In June 2024, after inspection, Deputy Minister of Transport Nguyen Xuan Sang requested Nha Trang Shipbuilding Company and Cam Ranh Shipbuilding Company to urgently implement the handling according to Resolution No. 220/NQ-CP of the Government, Decision No. 136/QD-BGTVT dated February 6, 2024 of the Ministry of Transport and the instructions of the Shipbuilding Industry Corporation.
In particular, proactively and actively carry out propaganda and dissemination to all cadres and employees and inform partners about the Government's policy. Based on the actual situation of each enterprise, research and report to the Shipbuilding Industry Corporation on the handling plan in the coming time, ensuring a thorough handling according to legal regulations; not allowing loss, waste, or negativity to occur.
Arrange and organize funding sources to resolve policies and regimes for employees who are still in debt and pay according to regulations; research and develop plans to support employees when handling businesses...
According to the leader of the Shipbuilding Industry Corporation's Trade Union, more than 50 workers at Cam Ranh Shipbuilding Company who are owed benefits will be given priority after bankruptcy. The workers will be transferred to a new unit or have their benefits resolved according to their wishes.
