Being reported to have a problem when registering a dependent, what should I do?
On February 18, 2025, the Dong Xoai - Dong Phu Tax Department received an email from the Binh Phuoc Provincial Tax Department with a Transfer Form No. 201/PCTCT dated February 17, 2025 from the General Department of Taxation regarding the response to taxpayers' questions related to the registration of dependents.
Taxpayer P.T.T.L. said that it had registered a dependent, Mr. P.V.T. (biological father) in January 2025. However, when carrying out the procedures, the income payment company informed that Mr. P.V.T. had previously registered as a dependent. The taxpayer requested the tax authority to verify to clarify the information.
After checking the tax management system, the Dong Xoai - Dong Phu Regional Tax Department confirmed that Mr. P.V.T. has been registered as a dependent of taxpayer P.T.T.L. (father-son relationship). Information recorded on the system shows that the registration date is February 4, 2025 at Dong Phu Gold Tin MDF Joint Stock Company.
The Dong Xoai - Dong Phu Regional Tax Department has notified taxpayers to know and take further steps if necessary.
Why is there a possibility of double registration of dependents?
According to Circular 111/2013/TT-BTC, dependents can only register once to reduce family deductions for one taxpayer. However, overlapping registrations can still occur due to a number of reasons:
errors from the tax management system: In some cases, data is not fully updated, leading to reports coinciding even though no one else has actually registered.
Other people who have registered before: If another family member declares the dependent without notifying, the taxpayer will be refused registration.
Entered incorrect information: When the company declares taxes to help employees, it entered the wrong MST or CCCD of the dependent.
What should taxpayers do when encountering this situation?
Re-check information with tax authorities
Taxpayers can request the Tax Department to check to determine who has registered a dependent before.
If there are errors, it is recommended that the tax authority adjust the data.
Working with income-paying enterprises
If the company enters incorrect registration information, it may request to adjust the data on the tax management system.
In case someone else has registered before, it is necessary to verify whether there is a mistake or not.
If incorrect registration is detected, it is necessary to carry out adjustment procedures
If it is determined that someone else has registered incorrectly, the taxpayer can send a request for adjustment to the Tax Department for direct management.
Attach documents proving personal relationships and a commitment from the dependent.
Registering dependents helps taxpayers enjoy a family deduction of 4.4 million VND/month according to current regulations. Therefore, when detecting errors, taxpayers need to quickly contact the tax authority to ensure their rights.
