The Ministry of Industry and Trade is seeking opinions on the draft Decree amending Decree 57/2025 regulating the mechanism for direct electricity purchase and sale between renewable energy power generation units and large electricity customers and Decree 58/2025 on the development of renewable energy and new energy.
Including the simplification of procedures for notifying the development of self-produced and self-consumed rooftop solar power. According to the draft, organizations and individuals who install a system that is not connected to the national grid only need to send a notice to the People's Committee at the commune level, instead of having to request many types of licenses as before.
The announcement includes the investor's name, capacity scale, location, start and completion time. The Commune People's Committee is responsible for synthesizing and reporting to the Department of Industry and Trade annually.
In case of connection to the national power system, people or businesses only need to fill in the information according to the prescribed form. Commune-level People's Committees receive and forward information to the power unit for management, monitoring and implementation guidance.
Notably, households installing systems with a capacity of less than 1kW (calculated according to investter capacity) are not required to notify. If there is a sale of surplus electricity products, the People's Committee of the commune must report to the Department of Industry and Trade within 5 working days for management according to regulations.
The Ministry of Industry and Trade also proposes to regulate the subjects of registration when installing rooftop solar power, including: Organizations and individuals with a connection system from medium voltage level and above and selling surplus electricity, or other units that need to be granted a Development Registration Certificate.
The Department of Industry and Trade of provinces and cities will be the competent authority to issue this certificate. The registration documents only require information form and design drawings, no mandatory construction permit, fire prevention and fighting acceptance or environmental procedures.
The draft also increases the maximum surplus electricity purchase rate from 20% to 50%, to encourage households to provide unused electricity to the national power system. The electricity purchase price is calculated according to the average market price of the previous year announced by the market operator, but does not exceed the ceiling price of the same type of ground-based solar power.
With self-made rooftop solar power systems installed on the project as public assets, the Ministry of Industry and Trade proposes 2 options. Option 1, no surplus electricity is sold; Option 2, allowing the sale of surplus electricity according to the Resolution of the National Assembly.
