On June 14, at the National Training Conference on the organization and operation of the Party organization, government, Fatherland Front (FPA), and political organizations at the commune level (new), Minister of Home Affairs Pham Thi Thanh Tra - Deputy Head of the Government Steering Committee on the arrangement of administrative units at all levels and the organization of local governments at both levels - gave thematic instructions: Overview report on the functions, tasks, and powers of local governments at both levels; general issues on decentralization, delegation of power, and division of authority to local governments at both levels.
Regarding the general issue, functions and powers of local governments at both levels, the Minister of Home Affairs emphasized that this is a content that has received much attention from localities, especially the issue of decentralization, delegation of authority and clearly defining authority between local governments at all levels, along with a number of key tasks that need to be implemented in the coming time.
The Minister pointed out that on June 12, the National Assembly " pressed the button" to pass the Resolution on the arrangement of provincial administrative units. The Resolution was passed to record changes in administrative boundaries nationwide, from 63 provinces to 34 provinces.
On June 16, the National Assembly will continue to pass a Resolution amending and supplementing a number of articles of the Constitution, passing the Law on Organization of Local Government (amended). On that basis, an official Resolution on the arrangement of provincial-level administrative units will be issued, applying to 34 new provinces and cities.
"The above contents are being implemented synchronously, so that by July 1, the whole country can officially operate the two-level local government model with full political and legal basis and practical requirements for sustainable development goals in the future" - Minister Pham Thi Thanh Tra said.
Presenting the functions, tasks and powers of the Provincial People's Committee, the Minister emphasized that this Draft Law on Organization of Local Government has elevated the position, role and main functions of the Provincial People's Committee, from a pure administrative management agency to a unified management center, law enforcement, proactiveness and sustainable development regulation in the locality.
The Minister of Home Affairs emphasized that this is a necessary adaptation in the context of reorganizing the two-level government model, towards an effective, efficient, efficient local governance system serving the people.
This draft law expands the group of independent tasks of the Chairman of the Provincial People's Committee from 11 to 23, clearly demonstrating the role of "conductor in the operation of local government".
In which, there are 5 typical groups of tasks: Organizing and directing law enforcement; operating the unified administrative apparatus from province to commune; decentralizing and delegating strongly and proactively; deciding on behalf of the People's Committee when necessary; and handling situations that arise beyond the resolution capacity of subordinates.
"When the Chairman of the Provincial People's Committee determines that a specialized agency or commune level shows signs of avoiding or pushing, the Chairman of the Provincial People's Committee has the right to handle it" - Minister Pham Thi Thanh Tra clearly stated.
