New guidelines on handling public assets when arranging administrative units

The Ministry of Finance guides the inventory, handover and handling of public assets when arranging administrative units, ensuring effective use, avoiding waste.

In order to carry out the assigned tasks in Decision No. 571/QD-TTg dated March 12, 2025 and Decision No. 857/QD-TTg dated April 14, 2025 of the Prime Minister, the Ministry of Finance has just issued additional guidance documents on the arrangement, arrangement, and handling of public assets when reorganizing administrative units at all levels.

According to the instructions, agencies, organizations and units subject to administrative unit reorganization must inventory, classify, make a list of public assets and develop a handling plan at the same time as developing the Reorganization Project. The handover and receipt of assets must be carried out according to the form prescribed in Decree No. 151/2017/ND-CP.

The principle of asset handling is to ensure suitability with the user, make the most of existing resources, have a long-term vision, and not be forced to re-implement the process of arranging houses and land according to Decree No. 03/2025/ND-CP. Prioritize the reasonable arrangement of assets between new administrative units in the locality; if necessary, the functions can be converted.

Regarding headquarters and facilities, assets will be prioritized for reallocation to grassroots administrative units or other state agencies in need. A common headquarters can be arranged for many agencies or transferred between provinces, districts and communes for effective use. Surplus headquarters can be converted into medical facilities, education, libraries, parks, cultural institutions or assigned to organizations with the function of managing exploited houses/land funds.

Regarding cars, if they are specialized vehicles for special activities, they will be transferred to the receiving unit. Vehicles for general work of district-level units are transferred to areas where they are lacking or handled according to regulations. In case it is necessary to pick up and drop off civil servants due to changing work locations, existing vehicles will be arranged, or vehicles will be purchased/rented according to regulations to ensure efficiency.

For machinery and equipment, the unit receiving the task will receive the corresponding assets. Popular machinery will be used at the new workplace, limiting new purchases. If there is still a surplus, it must be coordinated internally or handled according to regulations.

Regarding the deployment responsibility, the district People's Committee shall prepare a plan to handle assets within the scope of management (including district and commune) to send to the provincial People's Committee. If there is a plan to transfer communes between districts, the People's Committee of the district will receive the commune's property plan. The Department of Finance is responsible for presiding over and coordinating to develop a provincial public property plan. The ministries and central branches with local vertical units must also review the demand for assets; If redundant, transfer to the locality or transfer appropriately.

The Ministry of Finance requires units to report to be guided or submit to competent authorities for consideration and decision if they encounter problems in the implementation process.
