Son Hai Group Company Limited has just sent a document to the Binh Phuoc Provincial Construction Investment Project Management Board regarding the objection to the results of the selection of contractors for the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway Construction Package, the section passing through Binh Phuoc Province.
Previously, the investor had informed that this contractor had been busted for not meeting the requirements for machinery and construction equipment for the construction of the package.
The report of the expert team said that the bidding documents have specific requirements for each type of construction equipment mainly in the bidding package and require supporting documents for machinery and equipment for construction.
At the same time, the dossier also requires explanations of the plan to arrange vehicles and machinery mainly for work in the bidding process. Vehicles and equipment must ensure technical safety and environmental protection inspection or have an inspection certificate according to current regulations and must prove the ability to mobilize vehicles and equipment for implementation.
Contractors must provide detailed information about the main motorbike equipment proposed according to the webforms on the national bidding network and fully according to the requirements of the bidding documents.
According to the expert team, in comparison with current legal regulations, Son Hai's bidding documents did not include technical safety and environmental protection inspection documents or inspection certificates, in accordance with regulations, including 12 types of equipment.
It is worth mentioning that after the bidding was opened, on April 11, 2025, through the national bidding network, the bidding party issued a document clarifying the request of the Contractor to provide inspection certificates for 12 types of equipment that have not been inspected for technical safety and environmental protection, or inspection certificates according to current regulations.
On April 16, 2025, the contractor issued a document explaining, contractor Son Hai affirmed: "All of our above 12 equipment have inspection certificates according to regulations", so the contractor did not agree to replace them but only added additional construction equipment with inspection documents for the bidding party to evaluate.
However, according to the expert team, through inspection, evaluation and consultation with specialized agencies, the expert team concluded that the 12 initial bidding equipment were accompanied by documents for technical safety and environmental protection inspection or inspection certificates that were not in accordance with regulations and were not legal. The contractor provided information and documents that were not objective in the bidding documents, in order to distort the results of contractor selection, so E-HSDT was assessed as not meeting the prescribed criteria.

On May 26, Son Hai Group Company Limited sent a document to the Binh Phuoc Provincial Construction Investment Project Management Board to express its disagreement with the results of the selection of the contractor for the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway Construction Package, the section passing through Binh Phuoc province.
According to Son Hai, the expressway construction package announced to be opened for bidding is more than 880 billion VND. Among the participating contractors, Son Hai Group is the unit that offered the lowest price - more than 732 billion VND, saving the State budget more than 148 billion VND (equivalent to a discount rate of nearly 17%). However, this group did not win the bid because it did not meet the technical requirements of this package.
Meanwhile, the results announced show that the winning bidder is the contractor with the highest bid price - more than 866 billion VND, saving the state only about 14 billion VND.
This enterprise believes that it has completed many key projects and works with high quality. Giving such reasons affects the reputation of the business. At the same time, it does not save much cost for the State.
Talking to the Lao Dong Newspaper reporter, the Chief of the Office of Binh Phuoc Provincial People's Committee said that it is advising to lead the provincial People's Committee to direct the Management Board of Binh Phuoc Construction Investment Project to have clearly reported this case to the provincial People's Committee and Binh Phuoc Provincial Party Committee. Secondly, it is suggested that the Management Board of Construction Investment Projects of Binh Phuoc Province invites the contractor, Son Hai Group to work.
The Chief of the Office of Binh Phuoc Provincial People's Committee added that, through preliminary grasp, the bidding was widely implemented.
