This is the content stated in the draft Decree on determining the authority of the internal affairs sector when organizing local governments at two levels. The draft is chaired by the Ministry of Home Affairs and is being appraised by the Ministry of Justice.
In the draft Decree, the Ministry of Home Affairs clearly states the principles of decentralization of authority and direction of the Steering Committee, the draft decentralizes authority in the direction of:
The commune level mainly implements policies issued by the central and provincial levels, focusing on tasks of serving the people, directly solving the problems of the community, providing basic and essential public services to the people in the area.
The new commune-level government assumes the tasks and powers of the local government at the commune level and the tasks and powers of the current district-level local government.
Provincial authorities will manage, inspect and supervise the activities of local authorities at the commune level.
Notably, the Ministry of Home Affairs proposes the authority to handle court procedures.
Accordingly, the Chairman of the People's Committee of the commune has the authority to recognize the campaigning committee to establish the Association; allow the establishment, division, separation, merger, consolidation, dissolution, renaming and approval of the Charter; Suspension of operation for a definite term, allowing back operation for the Association to operate within the commune as prescribed in Clause 4, Article 15 of Decree 126/2024/ND-CP.
The Ministry of Home Affairs also clearly stated the responsibility for state management of the commune-level People's Committee's association, including:
Management and inspection of compliance with the law on associations and operating conditions within the commune. Inspect financial activities and assets, resolve complaints and denunciations, handle violations of assets, finance, and accounting for activities within the commune.
Reward or propose competent authorities to reward associations, organizations and individuals with achievements according to the provisions of law.
Resolve complaints and denunciations and handle violations related to administrative decisions and public service activities of cadres and civil servants in organizations under the People's Committee at the commune level according to the provisions of law.
Consider and decide to assign tasks to the association to operate within the commune in accordance with the association's field of operation. Every year, synthesize and report to the Provincial People's Committee on the organization, operation and management of activities within the commune.
Establish a social network database according to the management and coordination in building, operating, and managing a database on social activities at the commune level and other tasks as prescribed by law.
