The Lao Dong Newspaper Legal Consulting Office replied:
Point c, Clause 1, Article 1, Law on Organization of Local Government 2025 (effective from March 1, 2025) stipulates: Communes, wards and towns (hereinafter referred to as commune level) are administrative units.
Clause 1, Article 34, Decree 33/2023/ND-CP stipulates the allowance regime for part-time workers at the commune level as follows:
1. Part-time workers at the commune level are entitled to allowances. The central budget implements allowance contracts including support for social insurance and health insurance contributions to pay monthly expenses to part-time workers at the commune level as follows:
a) Type I commune-level administrative units are allocated an allowance fund equal to 21.0 times the basic salary;
b) Type II commune-level administrative units are allocated an allowance fund equal to 18.0 times the basic salary;
c) Type III commune-level administrative units are allocated an allowance fund equal to 15.0 times the basic salary.
For commune-level administrative units with an additional number of non-professional workers at the commune level as prescribed in Clause 2, Article 33 of this Decree, the total allowance fund contract is calculated to be increased corresponding to 1.5 times the basic salary/01 additional non-professional worker.
Thus, part-time workers in the ward are entitled to the above allowance regime.
