Criticism contributes to building law in a complete way
According to the provisions of the Constitution and law, the Vietnam Fatherland Front (VFF) and the Vietnam Trade Union have many important functions. Among them, the outstanding functions are representing and protecting the legitimate and lawful rights and interests of the people and implementing democracy, strengthening social consensus; supervising and social criticism of the VFF; or representing, caring for and protecting the legitimate and lawful rights and interests of trade union members and workers; participating in inspection, examination, and supervision of the activities of state agencies, organizations, units, and enterprises on issues related to the rights and obligations of workers of the Vietnam Trade Union. These are important functions, requiring a lot of understanding of the law.
Lawyer Nguyen Van Hau - Member of the Central Committee of the Vietnam Fatherland Front, Head of the Media Agency of the Vietnam Bar Federation - said that according to the general principle, civil servants and public employees are only allowed to do what the law allows within their authority. This principle has long become a habit that civil servants and public employees tend to perform very well what the law stipulates, but the critical nature is not high.
Meanwhile, lawyers, with their functions, legal knowledge and professional habits, tend to base on the provisions of law to protect their clients. It is from the practical work of consulting customers, protecting the rights of clients, and litigation in court that lawyers also form good critical thinking. For example, when defending or defending clients in court, lawyers must present their arguments and "argue" with fellow lawyers, even representatives of the Procuracy, to convince the trial panel. This argument must be linked to the provisions of law, agreements of the parties in the contract, and analyze the suitability with the reality of life and law enforcement practice to protect the rights of clients.
According to lawyer Hau, criticism is the best way to contribute to building law in a complete way. When the law is completed, the State, people, workers, laborers and businesses will all benefit. From there, lawyer Hau proposed that there should be a public lawyer institution for the Vietnam Fatherland Front and the Vietnam Trade Union.
The lawyer's understanding of the law will be very helpful
Agreeing with the above views, lawyer Tran Phi Dai - Ho Chi Minh City Bar Association - said that to represent and protect the legitimate and lawful rights and interests of the people or trade union members and workers, or to carry out supervision, first of all, it is very necessary to understand the law to see if agencies and units are implementing the law correctly and fully.
In fact, many officials of the Vietnam Fatherland Front, trade union officials have a deep understanding of the law and perform very well the function of representing and protecting the legitimate and lawful rights and interests of the people or trade union members and workers. Many cases, from the supervision activities of the Vietnam Fatherland Front or representatives of trade union officials, have brought benefits to the people, trade union members and workers, receiving the consensus and support of the people and workers.
Lawyer Dai also said that if there is a public lawyer institution for the Vietnam Fatherland Front and the Vietnam Trade Union, the lawyer's understanding of the law will be very useful for the Vietnam Fatherland Front and the Vietnam Trade Union. In addition, if there are public lawyers, the independent criticism will be higher.
Understanding the law and high criticalism will contribute to building more complete laws. At the same time, the effectiveness of cases representing and protecting the legitimate and lawful rights and interests of the People or trade union members and workers will greatly contribute to affirming the spirit of respecting the law, ensuring fairness for all classes of people and affirming the correct policy of the Party and State on the functions of the Vietnam Fatherland Front and the Vietnam Trade Union," lawyer Dai said.
