On January 16, Vice Chairman of Phu Tho Provincial People's Committee Phan Trong Tan signed Decision No. 104/QD-XPHC, imposing administrative sanctions in the fields of planning and investment, environmental protection, land, livestock and water resources against Mr. Nguyen Thanh Hai (Yen Lap town, Yen Lap district, Phu Tho province) - owner of a broiler farm.
Mr. Hai was fined for 8 violations. Some of the violations include: Implementing the project before being granted an Investment Registration Certificate or Investment Policy Approval, Investment Policy Approval at the same time as Investor Approval, Investor Approval (fine of 75,000,000 VND); Not having an environmental license as prescribed (fine of 160,000,000 VND); Not arranging or arranging a hazardous waste storage area that does not meet technical requirements as prescribed (fine of 45,000,000 VND).
Other violations: Failure to ensure safe distances in livestock farms; Violation of regulations on livestock declaration; Using special-use forest land, protective forest land, production forest land for other types of land (illegally); Encroaching or occupying land managed by State agencies and organizations; Exploiting and using water.
The total fine for the above acts is 325,431,000 VND.
At the same time, an additional penalty of suspending the operation of the broiler farm for 4.5 months was applied.
Regarding remedial measures, Mr. Hai is required to carry out procedures for granting an Investment Registration Certificate and approving the investment policy according to regulations; forcing the scale of livestock farming to be suitable with the prescribed distance; forcing the restoration of the original state of the land before the violation; and stopping all groundwater exploitation activities.
The above penalty decision takes effect from the date of signing and promulgation.
