On the morning of March 11, in Hanoi, the Office of the President held a press conference to announce the President's Order on promulgating the Law on Promulgation of Legal Documents passed by the 15th National Assembly at the 9th Extraordinary Session.
Accordingly, the provisions of the law must be stable and long-term, regulating issues under the authority of the National Assembly, while issues that are frequently changing are assigned to the Government, ministries, branches and localities to regulate.
Deputy Minister of Justice Nguyen Thanh Tinh said that the process of building new laws according to the provisions of the Law not only ensures shortening time, but still improves "productivity", promptly meets the requirements of practical national development in the new era, ensuring "quality" of legal documents.
It is true that we must "timely" and "meeting" the requirements of practical development. It is necessary to recognize that the situation of laws waiting for decrees and decrees to be applied to life has existed for too long. Agencies that develop legal documents are slow, creating legal gaps, causing damage to people and businesses.
Over the years, the situation of debt and the delay in issuing detailed regulations for law enforcement has affected the adjustment of life relations, hindering development.
Therefore, the regulation on applying shortened procedures in the development and promulgation of circulars is necessary, or rather urgent. According to this regulation, the time to develop and promulgate according to shortened procedures only takes about 1-2 months (down 6-8 months compared to the current process).
To shorten the process of developing and issuing legal documents quickly, it is necessary to have people who are good at their profession and have a good grasp of the law. Legal documents must not only be drafted quickly but also be of good quality.
To achieve quality, regulations need to avoid overlap, conflict with other legal documents, and even illegal revoking.
Legal documents must be standard and highly consistent. The regulation must be clear, do not let it be issued but not implement it due to lack of practicality, the regulation on penalties for smoking in public places or littering, urinating but cannot be punished in practice is an example.
An inappropriate regulation when applied to life is a waste of budget, not to mention it can lead to general damage to society.
