According to the drafting agency, the new draft decree was developed on the basis of inheriting Decree No. 29/2023 and has amended and supplemented a number of contents.
Notably, Point d, Clause 1, Article 2 of Decree No. 29/2023 stipulates the subjects implementing the staff streamlining policy: There are 2 consecutive years at the time of considering staff streamlining, cadres, civil servants and public employees have 1 year of quality classified as task completion and 1 year of not completing tasks but cannot be arranged for other suitable jobs.
In the new draft decree, the Ministry of Home Affairs proposed to replace it with consecutive previous regulations or within the year, consider streamlining the payroll to classify quality as not completing the task.
Thus, it is possible to resolve the dismissal for civil servants who have not completed their tasks for 1 year.
This is a drastic step in streamlining the apparatus and streamlining the payroll.
Minister Pham Thi Thanh Tra was once determined to overcome the lifelong staffing thinking. Therefore, it is necessary to design a mechanism to " enter and exit", completely abolishing the payroll for life.
To do the above, there must be legal regulations, 1 year of not completing the task can be terminated under the new Decree as a basis for handling weak cadres and civil servants.
Thus, to survive in the apparatus, cadres and civil servants must work wholeheartedly, solving the requirements of people and businesses in the spirit of service. Those who work ineffectively, cause difficulties for people, lose business hours, and are considered not to have completed their tasks.
However, to accurately assess whether cadres and civil servants complete their tasks or not is not easy if they only vote for A, B, C in the old way, emotionally, respectfully, and let things go.
In addition, there are cases of each other's defense, faction, and favor, leading to un obstructive and unfair assessments. Sometimes, talented and capable people are isolated and excluded.
Regarding the assessment of cadres, Minister Pham Thi Thanh Tra said: "In the future, a separate decree will be issued on assessment, with KPI, data for assessment, taking work products as a measure, not a general determination".
To streamline the apparatus, streamline the payroll, select and use the right people with the right capacity to serve the people, there needs to be an accurate measure, that is the provisions of the law.
Hopefully, the new decree will create changes in the awareness of cadres and civil servants about their responsibility for their work. Instead of being a civil servant for life, a person without capacity can only last a year.
