The Ministry of Home Affairs has completed and sent its opinions on the draft Submission, draft Law on Cadres and Civil Servants, and the draft law expected to be submitted to the National Assembly at the upcoming 9th session.
Compared to previous regulations, the draft Law adds the form of "eliminating the status of the position and title held" showing efforts to increase deterrence for civil servants.
Unlike the current regulations in Decree 112/2020/ND-CP, the addition of a disciplinary form of "detaining status" will erase the past mark of seriously violating officials, such as corruption and degradation.
This form of discipline will have a strong impact on personal honor and reputation - which is very important in Vietnamese culture.
In fact, not only in Vietnam, it shows that cadres who have held leadership positions and titles, even after retirement, still receive the respect of the organization and society and always take that as a source of pride.
So if they are disciplined and "erased of status", it means that they will lose the "glow" of the past.
They were even " deprived" of honorary privileges such as being invited to attend major political events, holding consulting roles, being away from the community...
And from a person who was once influential, praised, praised, and violated them to the point of disciplining them with "dished off their status", they became the ones that many eyes were watching.
For many leaders, this is more fearsome than imprisonment.
The new disciplinary forms proposed in the Draft Submission and Draft Law on Cadres and Civil Servants as amended this time also show adjustments in accordance with reality.
For cadres, the draft maintains the 4 old forms and adds "eliminate status", creating a clear disciplinary scale. For civil servants, replacing "number of office" and "lowering salary" with "forced dismissal" and "erasure of status".
These new forms of discipline not only show more drastic handling, avoiding half-time measures but also open up the possibility of additional legal proceedings.
If there are serious violations such as embezzlement, cadres, even retired cadres, can still be imprisoned and have their assets confiscated, because the statute of limitations is calculated from the time of violation. This creates great pressure, preventing the mentality of "safe landing" of leaders and civil servants.
The positive side of "exorcism" discipline is also the strong deterrent effect.
Once they know that even after retirement, their position can still be erased if they are found to have violations, cadres will be afraid, will have to be more careful in their actions, cultivate their ethics and stay away from temptations.
Knowing fear will promote the sense of responsibility of cadres, helping to build a cleaner and more efficient apparatus, in line with the spirit that the draft Law aims for.
Therefore, "eliminating the status of positions and titles that have been assigned" is not only a punishment but also a tool to clean up the team, strengthen discipline, and strengthen people's trust in the public authority system.
