From drug theft cases, talking about the death penalty for the crime of manufacturing and trading fake drugs

Lê Thanh Phong |

Stealing drugs and functional foods continuously occurs in Ho Chi Minh City and Da Nang.

It is unimaginable that drugs and functional foods are dumped like garbage, clearly these products have problems with quality or illegal business.

The owners of these shipments initially confessed that they were afraid of being discovered to be doing business in violation, so they hired people to dump and burn goods to destroy the evidence.

Initially, the authorities have determined the origin of the shipments and will clarify the violations, identifying them as poor quality or counterfeit goods.

In this case of illegal dumping of drugs and functional foods, there can be signs of illegal business activities; dumping and burning drugs and functional foods in violation of regulations, causing environmental pollution.

Regarding whether the product is fake or not, the authorities will have a conclusion after having the test results.

But theft of drugs and functional foods is not only in Ho Chi Minh City.

On the afternoon of June 10, the authorities of Hoa Hiep Nam ward, Lien Chieu district - Da Nang city coordinated with the police to inspect and record the scene of a large amount of new drug discovered on Xuan Thieu 21 street.

The drug strips clearly print the name "Cetecocenzitax 25mg", the expiration date is August 2026. According to a medical staff member, this medicine helps prevent motion sickness, reduce dizziness, ear muzzles, nausea and vomiting due to vestibular disorders.

According to the provisions of criminal law, the crime of manufacturing and trading counterfeit medicine can be punished with up to life imprisonment or death if it causes particularly serious consequences such as death, illegal profits of VND2 billion or more.

However, the draft Law amends and supplements a number of articles of the Penal Code (amended), proposing to remove the death penalty for 8 crimes, including the crime of manufacturing and trading counterfeit goods as medicine and disease prevention.

There have been many controversial opinions regarding the death penalty for this crime. Some delegates said that the production and sale of counterfeit drugs is mass murder.

At the meeting of the National Assembly Standing Committee giving opinions on the reception, explanation, and revision of the draft Law amending and supplementing a number of articles of the Penal Code (amended) held on the afternoon of June 10, Chairman of the Law and Justice Committee Hoang Thanh Tung said that there were opinions suggesting keeping the death penalty for 4 crimes, including the crime of manufacturing and trading counterfeit goods as medicine.

Counterfeit goods are everywhere, including many products such as medicine, most recently the case of Thanh Hoa Provincial Police dismantling a large-scale counterfeit drug production and trading ring nationwide, arresting many subjects.

In this situation, it is necessary to consider the proposal not to abolish the death penalty for the above crime.
