Responding to this content, the Da Nang Department of Health has the following opinion:
Regulations on transferring patients between health insurance examination and treatment facilities (HI) are stipulated in Law No. 51/2024/QH15 amending and supplementing a number of articles of the Law on Health Insurance (Clause 22, Article 1) and Article 9, Article 10 of Circular No. 01/2025/TT-BYT dated January 1, 2025 of the Minister of Health detailing and guiding the implementation of a number of articles of the Law on Health Insurance.
The transfer of patients between health insurance medical examination and treatment facilities is carried out in accordance with the provisions of the law on medical examination and treatment. The transfer of patients between medical examination and treatment facilities is carried out according to the professional requirements and response capacity of medical examination and treatment facilities.
Cases of transferring patients between health insurance medical examination and treatment facilities in the correct order include:
Transfer patients between health insurance medical examination and treatment facilities in the same level of medical examination and treatment, from the initial level of medical examination and treatment facilities to the basic level of medical examination and treatment facilities, from the basic level of medical examination and treatment facilities to the specialized level of medical examination and treatment facilities according to professional requirements, patient's condition or beyond the response capacity of the medical examination and treatment facility outside the prescribed cases for people with chronic diseases, long-term treatment, rare diseases, serious diseases, diseases requiring surgery or using high technology according to the provisions of Circular No. 01/2025/TT-BYT.
Transfer patients from initial-level medical examination and treatment facilities to specialized medical examination and treatment facilities in cases where the response capacity of basic medical examination and treatment facilities in the province is exceeded;
Transfer patients who have been treated stably from specialized medical examination and treatment facilities to basic or initial medical examination and treatment facilities, transfer patients from basic medical examination and treatment facilities to initial medical examination and treatment facilities for further treatment and monitoring;
Transfer patients from specialized or basic medical examination and treatment facilities to initial health insurance medical examination and treatment facilities for treatment, management, and monitoring of chronic diseases;
Transferring patients between medical examination and treatment facilities for people with chronic diseases or long-term treatment according to the list of diseases specified in Circular No. 01/2025/TT-BYT, the medical examination and treatment transfer form is valid for 01 year from the date stated on the transfer form;
In case the person with a health insurance card goes to the medical examination and treatment alone without complying with the provisions of Articles 26 and 27 of the Law on Health Insurance and falls under the provisions of Points e, g, h (except for cases where 100% is entitled to points e and h) Clause 4, Article 22 of the Law on Health Insurance, the medical examination and treatment facility will then transfer it to another medical examination and treatment facility according to professional requirements;
In case of emergency care, after the emergency treatment phase, the patient is transferred to a residential treatment facility at the medical examination and treatment facility where the patient was receiving the emergency treatment or transferred to another medical examination and treatment facility for continued treatment according to professional requirements or transferred to the place of initial medical examination and treatment registration after stable treatment.
According to data managed by the Department of Health, Thang Hoa General Hospital, Thang Binh Regional Medical Center, Da Nang General Hospital, Da Nang Dermatology Hospital are basic medical examination and treatment facilities.
The transfer of patients between medical examination and treatment facilities is carried out according to the professional requirements and response capacity of medical examination and treatment facilities.
Based on the above regulations, medical examination and treatment facilities are allowed to treat patients to health insurance medical examination and treatment facilities at the same level of medical examination and treatment according to professional requirements, patient's medical condition or beyond the capacity of the medical examination and treatment facility to respond.
