The draft Law on amending and supplementing a number of articles of the Law on Health Insurance was submitted to the National Assembly at the 8th Session of the 15th National Assembly.
The draft amendments and supplements to a number of articles of the Law on Health Insurance proposes to remove referral procedures for some rare diseases, serious diseases... to be transferred directly to higher professional levels to reduce procedures, create convenience, reduce out-of-pocket expenses for people, and save costs for the Health Insurance Fund.
Amendments to regulations on medical examination and treatment at the right and wrong medical facilities (inter-hospital) are updated according to the technical expertise level of the 2023 Law on Medical Examination and Treatment.

Amend regulations on initial health insurance examination and treatment registration and patient transfer between health insurance examination and treatment facilities to synchronize with regulations on technical expertise levels in the direction of creating more convenience for people and decentralizing and delegating authority to the Department of Health on initial health insurance examination and treatment registration and health insurance card allocation.
Accordingly, the draft stipulates that patients are allowed to go to medical examination and treatment facilities at the basic or advanced technical level in case of diagnosis and treatment of certain rare diseases, serious diseases, diseases requiring surgery or using advanced techniques according to the list of diseases and techniques prescribed by the Minister of Health: 100% payment of inpatient and outpatient health insurance examination and treatment costs according to the prescribed percentage of the benefit level.
According to the draft law submitted by the Government to the National Assembly, the Ministry of Health proposes cases where health insurance participants are paid when they go to a hospital other than the initial registration place or do not have to go through the procedure of transferring to a higher level hospital. Emergency patients at all hospitals nationwide are paid 100% of the cost of inpatient and outpatient medical examination and treatment according to the benefit rate.
