Fake and counterfeit goods are everywhere and are not completely handled
Discussing with Lao Dong about the problem of counterfeit goods at Ninh Hiep market, Mr. Nguyen Dang Sinh - Chairman of the Vietnam Association for Anti-Counterfeiting and Brand Protection (VATAP), said that this problem has existed for many years, market management has also organized many inspections but still exists, and has not been completely resolved.
"For counterfeit goods to spread, the responsibility belongs to the market management force of the Ministry of Industry and Trade. Based on the function and task, market management must be responsible for the authority. If the enforcement force does its job properly, responds more resolutely, and is not afraid of losing heart, the situation will be more positive" - Mr. Nguyen Dang Sinh emphasized.
According to Mr. Nguyen Dang Sinh, recently due to restructuring the apparatus, the management rights were decentralized to localities, through the Market Management Sub -Departments under the Department of Industry and Trade of each province. Therefore, the responsibility of handling fake and smuggled goods in Ninh Hiep and La Phu is now belonging to the People's Committee of Hanoi City, Hanoi Department of Industry and Trade. The Industry and Trade sector is responsible for directing the market management force to capture, inspect and handle violations in the area.
The Government issued Decree 24/2025/ND-CP amending Decree 98/2020/ND-CP regulating administrative sanctions for violations in commercial activities, production and trading of counterfeit and prohibited goods and protection of consumer rights. However, in recent times, many cases have been ignored or not handled enough to deter. The authorities have not done it resolutely, regularly, and continuously, so businesses selling counterfeit goods are still recovering.
"For the penalty, for example, the first penalty is 500,000 VND and doubled in the next inspections for repeat violations. If it is repeated for many consecutive days, the trader will have to terminate the item.
There needs to be a determined attitude of state management agencies and local government committees, especially market management forces. If we actively follow the correct procedures and strictly handle all violations, the situation of counterfeit goods and counterfeit goods will be significantly reduced. Therefore, the responsibility and will of the forces in inspection and handling is the decisive factor for success or failure" - he emphasized.
Domestic enterprises find it difficult to compete with counterfeit and smuggled goods

For example, many smuggled products from China are very cheap, mainly through smuggling routes, so they are not subject to tax. Meanwhile, domestic manufacturing companies face higher labor costs, taxes, and factories, making competition very difficult. Many businesses are forced to shift production direction or cut products, because they have invested in equipment but the more they do, the more they lose. They hope that the authorities will intervene to clean up the market and help restore domestic production. " businesses that are genuine and comply with regulations will have difficulty competing with counterfeit and smuggled goods" - Mr. Sinh said.
Discussing with Lao Dong about the situation of counterfeit goods still being sold in the Ninh Hiep market area, the Hanoi Market Management Department admitted that Ninh Hiep market (Gia Lam, Hanoi) has long been famous as a transit point for trading floating goods, especially counterfeit goods, counterfeit goods of famous brands... This is one of the hot spots for the production and trading of counterfeit goods, causing many consequences for consumers, genuine businesses and market order.
Faced with this situation, the Hanoi Market Management Department informed - has proactively developed and implemented plans and measures to resolutely control and handle violations of counterfeit goods at hot spots such as Ninh Hiep market.
Especially according to Plan No. 01 dated May 17 to monitor, inspect and handle violations of strengthening the fight against smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights in the new situation that the Department of Domestic Market Management and Development (Ministry of Industry and Trade) has just issued. This will be the peak period of implementation of the fight against, scking, and handling of counterfeit, counterfeit, and smuggled goods nationwide.
