Plan inspection is almost ineffective
On May 22, the National Assembly discussed in the hall the draft Law on Inspection (amended).
Delegate Pham Khanh Phong Lan (HCMC Delegation) said that the draft is focusing on building a system of two-level inspection agencies. This also raises concerns about specialized inspections because there are only the Government Inspectorate and the Provincial/City Inspectorate.
According to the delegate, there will be certain difficulties when there are no specialized forces in districts/counties, only there are and rely on inter-sectoral forces.
The draft law has a number of provisions on specialized inspection, the responsibility of heads in implementing and organizing specialized inspections; departments must also ensure specialized inspections.
The delegate hopes that when drafting a decree or circular, there will be appropriate investment in regulations on specialized inspections to comply with the law.
According to the delegate, we are probably focusing a bit more on how to build laws to prevent abuse of power and negativity by inspectors. Meanwhile, the authority and weight that make inspection more effective have not yet had a solution.
Citing the great power of overseas inspectors, the delegate said that right from the time of law making, inspectors have been tied up in many ways.
The delegate wondered why there were no more relaxed regulations to allow surprise inspections to be more than planned inspections. Because the planned inspection is almost ineffective when that list must be made public from the beginning of the year and must be approved by superiors. Before going to the inspection as planned, there must be a notice to the unit to prepare some contents.
"In fact, there are still some units that have been notified but still violate, limiting many unexpected factors," the delegate emphasized.
According to the delegate, the problem of fake milk, fake functional foods, and fake medicine is on the rise, and the Prime Minister has directed a peak campaign to eliminate this problem.
However, when the inspection force went to wherever the goods were, they all went to hide them, the pharmacy said it did not sell functional foods... It is very difficult to catch them red-handed when there is a plan and a lot of information.
Thus, the female delegate said that it would make specialized inspectors ineffective. For example, units and individuals who, after being fined and having their administrative violations recorded, did not comply, did not pay fines, were expelled from the unit and opened a new facility. The delegate said that there are currently no sanctions for these issues.

Clearly stipulate intentional acts without deciding on inspection
Giving his opinion on the regulations related to prohibited acts in inspection activities, delegate Nguyen Tao (Lam Dong) proposed to stipulate more clearly the act of intentionally not deciding on inspection to avoid abuse of power.
For example, when an inspection agency receives clear denunciations but does not take action within a certain period of time, delegate Nguyen Tao said that there needs to be an internal monitoring mechanism such as requiring the head of the inspection agency to periodically report on cases where signs of violations are detected but no inspection decision is made to ensure transparency and clarity.
"It is necessary to clearly stipulate the reception and handling of complaints from inspectors about bribery and harassment through digital systems and information security for whistleblowers," said delegate Nguyen Tao.
