3 years of not completing tasks, public non-business units will be subject to dissolution

Resolution No. 221/NQ-CP promulgating the Government's Action Program to continue to improve and effectively operate the overall organizational model of the political system and the 2-level local government model has emphasized the task of arranging and reorganizing the network of public non-business units (DVSNCL).

The Ministry of Education and Training and the Ministry of Home Affairs shall preside over and submit to the Government or issue documents under their authority guiding the continued arrangement of public non-public schools, preschool, primary, and general education institutions in communes and wards in localities.

People's Committees of provinces and centrally-run cities direct to continue arranging public non-business units, preschool, primary, and general education institutions in communes and wards, and local health facilities (completed in August 2026).

According to Decree 299/2026/ND-CP of the Government recently issued, CBs belonging to 1 of the following 4 cases will be considered for dissolution.

First, the unit no longer has the function and task of providing public service services to serve society or supporting the implementation of state management tasks.

Second, the unit does not fully meet some conditions for establishment. These conditions include being consistent with the industry plan or the AP network development plan that has been approved; meeting the criteria and conditions for establishment according to specialized laws; ensuring the minimum number of employees as prescribed.

Usually, public service units when established must be assigned at least 15 employees. This regulation does not apply to units providing basic and essential public service services established under specialized laws.

For units that self-ensure regular expenditures or self-ensure both regular expenditures and investment expenditures, the number of employees identified in the establishment project has been approved by competent authorities.

The third case is that VMNCL has not completed its tasks for three consecutive years according to the assessment of competent authorities and the provisions of law.

Thus, the results of task performance must be determined through an official assessment by a competent authority. The Decree does not stipulate that the dissolved unit is based only on the results of one separate year, but must have three consecutive years of task failure.

The fourth case is that the dissolution is carried out according to industry planning, if any, or the development plan of the VMNCL network according to each industry and field.

The reorganization of YUs guaranteed by the state budget for regular expenditures or partially guaranteed by the state budget for regular expenditures must not increase the number of people receiving salaries from the state budget that has been approved by competent authorities.

In case of implementing the consolidation and merger of PSEs with financial autonomy at different levels, the level of financial autonomy of PSEs after consolidation and merger is implemented according to the decision of the competent authority to establish and reorganize the unit.

Previously, many localities had been and are continuing to arrange public non-business units, including educational institutions. In Can Tho, the plan to merge public non-business units is expected, the whole city has 1,153 public non-business units, expected to reduce 525 schools (45.5% rate), to 628 schools.
