4 groups of subjects entitled to policies and regimes when arranging the apparatus according to Decree 178

Decree 178/2024 (amended and supplemented in Decree 67/2025) stipulates the groups of subjects entitled to policies when implementing organizational structure arrangements.

The Ministry of Home Affairs has just requested ministries, agencies, and localities to conduct a general review and be responsible for the results of policy settlement for cases that have been decided to quit their jobs according to Decree 178/2024 (amended and supplemented in Decree 67/2025), after the State Audit Office (SAO) pointed out many errors.

Through auditing, it was discovered that some cases were approved for resignation, early retirement on the grounds of "not meeting task requirements, not meeting training qualifications according to professional and nghiệp vụ standards of the job position currently held after arrangement", while personal records and evaluation results for 3 consecutive years all completed tasks well or better.

These cases were detected at some units in Ho Chi Minh City, 43 cases in Dong Nai, 7 cases in Lam Dong, 45 cases in Dak Lak and 3 cases in Gia Lai. SAV believes that this gives rise to the risk of resolving regimes not to the right subjects.

Regarding the subjects of application of policies and regimes for cadres, civil servants, public employees, laborers and armed forces in implementing the arrangement of the organizational structure of the political system, the Government specifically stipulates in Article 2 of Decree 67/2025 amending and supplementing Decree 178/2024 as follows:

The first group, cadres, civil servants, public employees, people working under labor contracts in agencies, organizations, units specifically regulated and armed forces directly affected by the implementation of organizational structure arrangement, arrangement of administrative units at all levels:

This group includes civil servants and public employees who do not hold leadership or management positions; commune-level cadres and civil servants; some contract workers; officers, professional soldiers, national defense workers and public employees; officers, non-commissioned officers, police workers; people working in cipher organizations and leading and managing cadres, civil servants and public employees who wish to resign to serve the arrangement.

The second group, cadres, civil servants, public employees, and laborers receiving salaries from the state budget according to the provisions of law before January 15, 2019, and armed forces with 5 years or less of retirement age in agencies, organizations, and units that are not directly affected by the arrangement of the organizational structure but must implement staff streamlining, restructuring, and improving the quality of cadres, civil servants, and public employees.

The third group, people working within the staffing quota and receiving salaries from the state budget at associations assigned tasks by the Party and State at the central level, at the provincial level, and at the district level, are directly affected by the implementation of arrangement, consolidation, and merger of the organizational apparatus.

The fourth group, cadres who are not old enough to be re-elected or reappointed; cadres who meet the age conditions for re-election and reappointment to the Party Committee at the same level, whose working time is calculated from the date of starting the congress to be from 2.5 years (30 months) to 5 years (60 months) until reaching retirement age; cadres who are participating in Party committees in Party committees must end their activities and consolidate the organizational structure to be 5 years (60 months) or less until retirement age, wish to retire early and be approved by competent authorities.
