On May 20, the Government submitted to the National Assembly the draft Law amending and supplementing a number of articles of the Penal Code.
The draft law supplements Article 256a on the subjects of illegal use of drugs. Any person who illegally uses drugs in one of the following cases shall be imprisoned from 2 to 3 years:
First, within the period of self-medication, arrested drug rehabilitation, and treatment of drugs with replacement drugs according to the provisions of the Law on Drug Prevention and Control.
Second, undergoing post-retirement management according to the provisions of the Law on Drug Prevention and Control.
Third, he is under the management of illegal drug users and has been administratively handled by being sent to a forced detention facility according to the provisions of the Law on Drug Prevention and Control.
Fourth, within 2 years from the date of arbitrary termination of self-medication or treatment of drugs with replacement drugs according to the provisions of the Law on Drug Prevention and Control.
Violating this policy will be punished with imprisonment from 3 to 5 years.
The draft law also amends and supplements the regulation that anyone who organizes illegal use of drugs in any form will be imprisoned from 3 to 7 years.
Regarding illegal drug trafficking, anyone who illegally buys and sells drugs will be imprisoned from 2 to 7 years;
Committing one of the following cases shall be subject to imprisonment from 7 years to 15 years: Organizing; committing the crime twice or more; for 2 or more people; taking advantage of position and power; taking advantage of the name of an agency or organization; using a person under 16 years old to commit a crime of illegally selling drugs to people under 16 years old; crossing the border; plastic, pipe tobacco, or high- alcohol content weighing from 500 grams to less than 1 kg...
A person who commits one of the following cases shall be sentenced to imprisonment from 15 to 20 years or life imprisonment:
a) Antibiotic plastic, marijuana plastic or cocoa with a weight of 05 kg or more;
b) Heroine, Cocaine, Methamphetamine, Amphetamine, Ketamine, Fentanyl, MDMA, XLR-11 weighing 100 grams or more;
c) Coconut leaves; tar leaves (Catha edulis leaves); leaves, roots, stumps, branches, flowers, fruits of medical plants or other plants containing drugs prescribed by the Government with a weight of 75 kg or more;
d) Dried tobacco products weighing 600 kg or more;
d) Fresh pesticides weighing 150 kg or more;
e) Other solid drugs weighing 300 grams or more;
g) Other liquid drugs with a capacity of 750 milliliters or more;
h) There are 2 or more drugs in which the total weight or mass of those substances is equivalent to the weight or mass of drugs specified in one of the points from Point a to Point g of this Clause.
The violator may also be fined from VND 5,000,000 to VND 500,000,000, banned from holding a position, practicing a profession or doing certain jobs from 1 year to 5 years or having part or all of his/her assets confiscated.
