The Ministry of Home Affairs has issued guidance to resolve a number of difficulties and problems in implementing the 2-level local government organization model, including the content on the organization and operation of villages and residential groups.
The Ministry of Home Affairs said that the contents related to the election process of Village Heads and Heads of Residential Groups are stipulated in the Law on Grassroots Democracy and Decree No. 59/2023/ND-CP dated August 14, 2023 of the Government detailing a number of articles of the Law on Grassroots Democracy.
Article 6 of Decree No. 59/2023/ND-CP clearly states the preparation work for the election of Village Heads and Heads of Residential Groups.
Accordingly, the Chairman of the People's Committee at the commune level is responsible for issuing a decision to organize the election of Village Heads and Heads of Residential Groups; presiding over and coordinating with the Standing Committee of the Vietnam Fatherland Front Committee at the commune level to develop a plan, provide professional guidance and organize the implementation of the plan no later than 20 days before the date of the community meeting to elect Village Heads and Heads of Residential Groups.
issue a decision to establish an Election Team no later than 10 days before the date of holding a community meeting to elect a Village Head or Residential Group Head after reaching an agreement with the Vietnam Fatherland Front Committee at the commune level.
The election team includes: Representatives of the Front Working Committee in villages and residential groups as the Team Leader; members are representatives of mass organizations, politics - society and representatives of households in villages and residential groups (not candidates for Village Heads and Residential Group Heads).
The decisions must be notified to the people in the village or residential group, posted at the cultural house or community activity house of the village or residential group and notified on the radio system or in other forms suitable to the local conditions no later than 7 days before the election date.
The Head of the Front Working Committee in villages and residential groups organizes a meeting of the Front Working Committee in villages and residential groups to plan the list of candidates for Village Heads and Heads of Residential Groups; reports to the Party Committee of the village and residential group to unify the nomination of at least 1 person as a candidate for Village Head and Head of Residential Group; organizes a meeting of the Front Working Committee in villages and residential groups after receiving opinions from the Party Committee of the village and residential group to decide on the official list of candidates (at least 01 person).
The meeting content must be recorded in form No. 05 attached to this Decree and sent to the People's Committee at the commune level no later than 15 days before the meeting of the community.
According to the Ministry of Home Affairs, these regulations are in effect and are still suitable when implementing the 2-level local government model.
