Ensure unemployment insurance fund balance when restructuring the apparatus

According to the National Assembly's Social Committee, there are opinions suggesting adding principles and assigning the Government to regulate to ensure the balance of the unemployment insurance fund when restructuring the apparatus.

On the afternoon of January 6, continuing the 41st Session, the National Assembly Standing Committee reviewed and commented on the Draft Law on Employment (amended).

Reporting on a number of major issues regarding the reception, explanation and revision of the draft Law on Employment (amended), Chairwoman of the National Assembly's Social Committee Nguyen Thuy Anh said that compared to the draft submitted to the National Assembly at the 8th Session, the draft Law after being reviewed, received, revised and completed consists of 8 chapters with 64 articles (a reduction of 30 articles).

Implementing Resolution No. 27-NQ/TW, the Standing Committee of the Social Affairs Committee has revised the draft Law to ensure clear, substantive and concise regulations. This includes thoroughly cutting down and simplifying administrative procedures, creating the most favorable conditions for employees and employers...

Regarding unemployment insurance premium support, Ms. Nguyen Thuy Anh said that in the draft Law, the Government proposed to supplement the support regime for employers when employing disabled workers through unemployment insurance premium support under the responsibility of the employer.

The Standing Committee of the Social Committee supports the need for this policy to support employers who accept disabled workers, demonstrating the superior policy of our Party and State in caring for the vulnerable. However, the Standing Committee of the Social Committee still has concerns:

The draft Law currently stipulates "people with disabilities" in general, but according to the provisions of the Law on People with Disabilities, there are currently 3 levels of disability (mild disability, severe disability and extremely severe disability). The report does not have accurate statistics on workers with disabilities to be able to accurately forecast resources (The impact assessment report also estimates the cost at about 144 billion VND/year).

The draft law stipulates that the reduction of unemployment insurance premiums is the responsibility of employers to pay for employees with disabilities. Therefore, it is necessary to supplement the assessment of the impact on the Unemployment Insurance Fund (currently the Unemployment Insurance Fund is almost balanced between revenue and expenditure during the year).

According to Decision No. 64/2015/QD-TTg amending and supplementing Decision No. 42/2012/QD-TTg, "The central budget supports 100% of the costs for training, health insurance, social insurance, and unemployment insurance for ethnic minority workers". However, the draft Law submitted by the Government does not include ethnic minorities. Therefore, the Chairman of the Social Committee requested the Government to clarify.

Regarding the continued implementation of innovation and reorganization of the political system to be streamlined and operate effectively and efficiently, according to the Chairman of the Social Committee, at the time the Government submitted the draft Law, the policy of innovation and reorganization of the political system had not been thoroughly implemented.

Therefore, the draft Law has not anticipated the impact of implementing this policy, such as: Names, functions, and tasks of agencies and organizations in the draft Law (due to merger).

Policy for unemployed people due to organizational restructuring; Impact on unemployment insurance fund balance when reducing participants and increasing beneficiaries.

There are suggestions to add principles and assign the Government to regulate to ensure the balance of the Unemployment Insurance Fund in cases such as when restructuring the organizational apparatus.
