The draft Law on Savings and Combat of Waste is being appraised by the Ministry of Justice. This draft replaces the Law on Practicing Thrift and Combating Wastefulness (THTK, CLP) 2013.
The draft Law has eliminated a number of areas, shortening to only 35 articles.
After more than 10 years of implementing the Law on Investment Investment and Investment, the work of investment and investment has achieved certain results. However, the work of THTK and CLP in reality still exists and is limited.
Lawyer Hoang Van Doan (Hanoi Bar Association) assessed that the new draft law has overcome some shortcomings that the 2013 Law on Investment and Investment, which is also an existing law, has not clarified.
For example, the law lacks regulations on sanctions that are strong enough to deter and prevent possible waste cases. There is no regulations on building a national database publicly on savings and wastefulness to promptly update information about the situation of THTK, CLP across the country as well as as a basis for the National Assembly, the Vietnam Fatherland Front, mass organizations and people to have more facilities to monitor, supervise and check waste detection.
According to the drafting agency (Ministry of Finance), the new points of the Draft Law are studied, amended, and supplemented with 4 main contents.
Including the institutional content of the contents of Regulation No. 231-QD/TW dated January 17, 2025 of the Politburo on the protection of people fighting against corruption, waste and negativity to supplement and perfect regulations on rewards in thrift and waste prevention.
Discovering waste and responsibility for handling information on waste detection, protecting people fighting against waste to encourage all individuals and organizations to actively participate in saving and combating waste.
Article 5 of the draft Law stipulates the provision and handling of waste detection information and protection of those fighting against waste.
Accordingly, agencies, organizations and individuals have the right to provide information to the head of the agency, organization, head of the agency directly above the place of waste, the inspection, examination, investigation agency, People's Procuracy to review, resolve or post information on mass media according to regulations and must be responsible for the honesty and accuracy of the information provided...
The inspection, examination, State Audit agencies, and the heads of the direct superior agencies, when receiving information about waste, are responsible for directing and organizing clarification according to their functions and tasks, preventing and promptly handling according to their authority or recommending competent authorities to handle according to the provisions of law...
The remarkable point of the Draft Law is to encourage organizations and individuals with solutions and initiatives in thrift and combating waste to bring specific results or with information, denunciations, and combating waste in the true way or exceeding the assigned targets, savings targets and requirements for combating waste to be rewarded according to the provisions of the law on emulation and reward. This is mentioned in Article 31 of the draft Law.
Along with that, Articles 32 and 33 of the draft Law also specifically stipulate 9 groups of wasteful behaviors (the current Law on Practicing Thrift and Combating Wastefulness has only 4 groups of behaviors) and 9 groups of violations in organizing the implementation of waste prevention and control.
