In the Draft Circular on appraisal of newly built, converted and registered and inspected watercraft of the People's Public Security (CAND), the Ministry of Public Security said that after 8 years of implementation, Circular No. 47/2016/TT-BCA regulating the registration and inspection of watercraft of the People's Public Security has revealed a number of shortcomings, difficulties, problems and new problems arising in the implementation process, which need to be promptly amended and supplemented to suit the requirements and tasks in the new situation.
The development of a new circular aims to ensure consistency and unity in legal documents related to the inspection of watercraft as well as effectively implementing administrative procedure reform in the registration and inspection of watercraft; thoroughly decentralizing the inspection of watercraft; resolving difficulties and problems of the Public Security of units and localities in the process of implementing Circular No. 47/2016/TT-BCA.
Accordingly, the draft Circular proposes that the agency registering watercraft in the People's Public Security include:
The Traffic Police Department (CSGT) conducts the first inspection of watercraft of units under the Ministry of Public Security and watercraft that are appraised for newly constructed and converted according to the provisions of Chapter II of this Circular.
The Center for Inspection of Motor Vehicles and Inspection of Water Vehicles under the Vehicle Registration and Inspection Guidance Department, Traffic Police Department (hereinafter referred to as the Inspection Center) conducts maintenance inspection for water vehicles of units under the Ministry of Public Security, Provincial and Municipal Police under the central government. The inspection center has its own seal to serve the work according to regulations.
The Traffic Police Department of the provincial and centrally-run city police conducts initial inspection and maintenance inspection of watercraft of the provincial police; maintains inspection of watercraft of units under the Ministry of Public Security with headquarters in the locality.
The watercraft registration agency includes:
The Traffic Police Department conducts the registration and issuance of CAND watercraft registration certificates of units under the Ministry of Public Security.
The Traffic Police Department under the Provincial and centrally run city police shall carry out the registration and issuance of the CAND watercraft registration certificate of the local police.
Regarding the time limit for handling the inspection of watercraft, the draft Circular stipulates as follows:
The duration for granting certificates of technical safety and environmental protection of watercraft and technical inspection books of watercraft shall not exceed 3 working days from the date the watercraft is inspected and meets the requirements.
Deadline for changing or reissuing certificates of technical safety and environmental protection of watercraft and technical inspection books of watercraft: No more than 3 working days from the date of receiving a complete and valid dossier (for watercraft with an inspection period of 6 months or more).
No more than 3 working days from the date the watercraft is inspected and meets the requirements (for watercraft with an inspection period of less than 6 months or the inspection period expires).
Regarding the time limit for issuing, exchanging, and reissuing certificates of registration of watercraft, the draft Circular stipulates that it is no more than 3 working days, calculated from the date of receiving a complete and valid dossier.
