Authorized by the Prime Minister, Minister of Home Affairs Pham Thi Thanh Tra signed the Government's submission on the draft Law on Cadres and Civil Servants (amended) to the National Assembly.
The draft Law consists of 7 chapters and 52 articles, a reduction of 35 articles compared to current regulations; expected to be considered and approved by the National Assembly at the 9th Session.
The Government's submission stated that one of the contents of the draft Law amending and supplementing is the mechanism for management and use of cadres and civil servants.
The content of this latest draft has been revised and significantly changed compared to previous drafts that the Ministry of Home Affairs has consulted on, which is to continue to maintain regulations on job positions and civil servant ranks to ensure stability of the team of cadres and civil servants.
The concepts of job positions and ranks are completed to serve as a basis for continuing to innovate recruitment, assessment, planning, appointment, transfer, training, fostering... based on the principle that when they are arranged in professional or technical positions or positions, leadership and management positions will be considered for appointment to the corresponding rank (the content of promotion will be removed).
"The arrangement of personnel in job positions must ensure compliance with standards on professional qualifications and skills, associated with specific products and results according to the principle of getting in and out, getting up and down" - the Government's submission stated.
Regarding the job position of civil servants, the draft Law stipulates: job position name; job title standards; job description (work content and results of work, capacity framework); tasks, powers and responsibilities.
Job positions are divided into 3 types: Leadership and management job positions; professional and technical job positions; and support and service job positions.
Regarding civil servant ranks, the draft Law maintains 6 groups: Senior specialist and equivalent; main specialist and equivalent; specialist and equivalent; civil servant and equivalent; employee; other ranks as prescribed by the Government.
Currently, based on Article 42 of the Law on Cadres and Civil Servants 2008, supplemented by Clause 7, Article 1 of the Law on Cadres and Civil Servants and the 2019 amended Law on Public Employees, it stipulates:
Civil servant ranks and appointment to civil servant ranks: Senior specialist and equivalent; Senior specialist and equivalent; Specialist and equivalent; Cadre and equivalent; employee; Other ranks as prescribed by the Government.
