The draft Law on Cadres and Civil Servants (amended) stipulates the management of civil servants according to job positions, removing regulations on civil servant ranks according to current regulations.

The Ministry of Home Affairs has completed and sent its opinions on the draft Submission and draft Law on Cadres and Civil Servants (amended). The bill is expected to be submitted to the National Assembly at the upcoming 9th session.

In the draft Law on Cadres and Civil servants (amended), the Ministry of Home Affairs proposes to amend the concept of job position (which is the position, title and job of a cadres and civil servants associated with the functions, tasks and structure of agencies, organizations and units), in which, abolishing the content "associated with structure and rank of civil servants", and "to determine the payroll" to overcome the management position according to the management of the manager; Do not serve as a basis for the units to increase the payroll.

At the same time, supplement Article 19 (classification, content of job positions), Article 20 (based on determining job positions), Article 30 ( job position system), Article 31 (appointing civil servants when changing job positions) and the contents of recruitment, evaluation, training, fostering civil servants and contents related to civil servant management according to job positions.

According to the Draft Law, the employment position system of civil servants is ranked by hierarchy based on the standards of positions, titles, job descriptions and organizational structure of agencies, organizations and units, suitable to the organization of the Communist Party agencies of Vietnam, the State, the Vietnam Fatherland Front and socio -political organizations at the central level, provincial and at the commune level.

On that basis, the Draft Law removes the provisions of civil servants in the Law on Cadres and Civil servants, including: (1) Official public servant rank and appointed to civil servant rank; (2) transfer of civil servant rank; (3) Raising civil servant rank; (4) Organize the examination of civil servant rank; (5) contents related to the rank of civil servants in the Law on Cadres and Civil servants.

According to the Ministry of Home Affairs, the innovation of management of cadres and civil servants according to job positions will play a very important role in building a team of cadres and civil servants who are professional, efficient, effective, and efficient, and innovating the thinking of managing cadres and civil servants according to job positions, instead of ranks and levels.

Currently, implementing the current Law on Cadres and Civil Servants, 100% of ministries, branches and localities have developed and approved the Job Position Project, but it is still linked to the current structure of civil servant ranks and salary tables.

Therefore, during the time when the new salary table according to job position has not been designed, the implementation of gradual conversion to the mechanism for managing cadres and civil servants according to job positions still applies the current salary levels, so there is no great disruption.

Pursuant to the Law on Cadres and Civil Servants (amended), ministries, branches and localities will complete the Job Position Project to suit and gradually switch to a new management mechanism according to the roadmap.
