The Ministry of Home Affairs proposes to amend the list of localities applying the regional minimum wage

The provincial People's Committee can decide to choose a commune-level locality under the province to specifically apply the regional minimum wage.

The Ministry of Home Affairs is seeking opinions on the draft Decree on decentralization of state management tasks in the field of Home Affairs.

In the draft report, the Ministry of Home Affairs clearly stated the purpose of the draft decree to meet the requirements of the Government and the Prime Minister on the implementation of the Law on Organization of the Government and the Law on Organization of local governments and promptly promote decentralization and decentralization for a number of priority and urgent areas in the field of interior management for state management agencies at all levels and local authorities.

According to the draft Decree, the Chairman of the People's Committee at the commune level has the authority to receive:

Report of the labor leasing enterprise as prescribed in Article 56 of the Labor Code.

Collective labor agreements of enterprises as prescribed in Clause 6, Article 56 of the Labor Code.

Receive notice of temporary closure of workplace as prescribed in Article 205 of the Labor Code

The Government decentralizes to the Provincial People's Committee to decide on the selection of commune-level areas under the province to specifically apply the regional minimum wage as prescribed in Decree 74/2024/ND-CP dated June 30, 2024 of the Government regulating the minimum wage for employees working under labor contracts.

Notably, the Ministry of Home Affairs proposed to amend Clause 2 and Clause 3, Article 3 of Decree 74/2024/ND-CP dated June 30, 2024 of the Government regulating the minimum wage for employees working under labor contracts.

Accordingly, the Ministry proposes the list of areas in regions I, II, III and IV as follows:

Region I and Region II, including: communes and wards of Hanoi City.

Region I, Region II and Region III, including: communes and wards of Ho Chi Minh City and Hai Phong City.

Region II, Region III and Region IV include: communes of the provinces of Bac Ninh, Ninh Binh, Hung Yen, Phu Tho, Lao Cai, Thai Nguyen, Thanh Hoa, Nghe An, Quang Tri, Khanh Hoa, Lam Dong, Vinh Long, Dong Thap, An Giang, Ca Mau and the cities of Hue, Da Nang, Can Tho.

Region I, Region II, Region III and Region IV, including: communes and wards of Quang Ninh, Dong Nai, Tay Ninh provinces.

Region III and Region IV, including: communes and wards of Tuyen Quang, Cao Bang, Dien Bien, Lai Chau, Son La, Lang Son, Ha Tinh, Quang Ngai, Gia Lai, Dak Lak provinces.

The provincial People's Committee shall base themselves on specific socio -economic conditions of each commune and ward area to select and decide to apply specific minimum wages according to the region for communes and wards; Ensuring the minimum wage in the administrative unit at the grassroots level is not lower than the minimum wage corresponding to the area prescribed by the Government every year.

The draft Decree clearly states the repeal of the Appendix issued with Decree No. 74/2024/ND-CP dated June 30, 2024 of the Government regulating the minimum wage for employees working under labor contracts.

In 2024, the Ministry of Home Affairs issued a Decision on the survey in 2024 on labor and wages in enterprises.

The survey was conducted at 3,400 enterprises with 6,800 employees working in these enterprises.

Every year, the National Wage Council meets to advise the Government to adjust the regional minimum wage appropriately, to ensure the minimum living standard of workers.

Most recently, the National Wage Council advised the Government to issue Decree No. 74/2024/ND-CP. Accordingly, from July 1, 2024, the regional minimum wage will increase by an average of 6% compared to 2023.
